Show DISMISSED tiie charge of polygamy charles L is dismissed alic grapul jury lake hie caso hi hand at teu yesterday morning proceedings in the protracted whites polygamy case were resumed nt the commissioners of fice the only additional witnesses examined were the father and mother of elizabeth starkey jane and francis starkey who had been subpoenaed in hooperville Hoop erville both told the same story which was in effect that their daughter biad been living with the white family for the purpose of learning brush making that she had gone to arizona with them but returned alone that she had never come to sick although she had paid a visit to her home both said they knew nothing of her marriage to white and the mother added that she did not think lizzie had over held the relation of wife to any man the stubborn witness lizzie herself was then again brought forward and again puttee questions she had declined to answer quietly but firmly she once more re fused to make any reply and she was once more given into the custody of marshal ireland mr kirkpatrick then moved that the polygamy against white bo dismiss eda motion which the commissioner granted lie was still held in bonds however to answer to the grand jury on tho charge of unlawful chhabi tation and as mullet and solomon became liis sureties he was once more given ills liberty the case was at once taken up by the grand jury though aliat necessity there had been for their not taking it up in the first place except to give the commissioner a gentle whack at the fees is be yond the average ken and the witnesses were all examined over again which means more fees in time the inquisitors inqui camo to the rock against which the commissioner had been dashing himself for the past several days the rant witness a few minutes later the juryman jurymen jury men attorney and miss starkey filed into court which had been kept open during the day in anticipation of the event and the foreman handed the following document to judge zane to the afon the district court of ulah territory the grand jury of the above entitled court duly paneled em and sworn for the april term 1885 thereof respectfully there is now pending before said grand jury an investigation of the chargo against one charles L white wherein tho said charles L white is accused of the crimes of polygamy and unlawful cohabitation that testimony lias been introduced tending to show that the said charles L white did marry and take to wife one margaret hamilton between six and seven years since and that alio said maraaret hamilton then became and waa ills lawful wife and that she is detill alive and after the introduction of such testimony one elizabeth ann tf tarkey was called and sworn as a witness in said matter before said grand jury whereupon the follow ini questions were propounded to said witness arc you married to charles L white ha ie you at dav time within the last three years at the county of salt lake in tho territory of utah gone through any marriage ceremony charles L white you been married to Charlea L white within three years and within this county but said question or either of them the said elizabeth ann starkey refuses and declines and still does refuse and decline wherefore the grand jurors aforesaid request this honorable court to advise and instruct said witness whom they now produce before alie court whether or not eho is in duty bound to answer said questions or not or either of them C E foreman grand jury the judge announced that he thought the questions were proper ones this did not seem to influence miss opinion however As there seemed no her changing her mind tho judge briefly said that she should be imprisoned until euch time as she choose to answer until lier case waa other legally disposed of she acs cordingly went with the marshal and the grand jury dispersed miss starkey has rooms with miss deveraux Dever cux out at the pen S L herald |
