Show JUDGE OW BENNETT AS A ay pamphleteer judge C W bennett the salt lake lawyer who lately made him aalf conspicuous by going all the way to washington to lobby forca has just emerged before the public of utah as a pamphleteer on the mormon ques kioa judge bearett had usually been regarded as a sound and sensible attorney but when he wandered off to the national capital to per y form charitable service in the in ft terest pathe confirmation of tl e besmirched kalamazoo missionary justice people who could not credit leini with corrupt motives nor believe that he was engaged in exe curing hia part of a corrupt bargain were inclined to suspect that hia once brilliant mentality was falling into irreparable decay if indeed his reasoning were not tottering into decrepitude or hopeless imbecility and now the first thought that strikes us uron fi y f treading this pamphlet which judge bennett addresses to congress as a member of the national committee of the republican party is the sorrowful conviction that the salt lake authorities who are charged with the duty of caring for and committing the imbecile and the insane are their duty if judge bennett had solemnly prefaced bis pamphlet with a notice that ho had descended from the lc legitimate practice of a noble probes pr ofes abion to become a political scrub pamphleteer the fact could not w h ave been made more plain and yet the judge in the course of hia pamphlet screed makes a few good suggestions and affects a degree of love for utah and her people but upon examination it will be found thethis th athis enod suggestions are stale and have been made over and over again and again by the mormon press while his affected admiration or affection for the dominant peo pie of this territory is aply a sorry it to disguise his hostility to and v contempt for everything mormon but in order that our readers may the better understand us we may to quota from mr bennetts pamphlet with notable eccentricity and an attempt at ia ir nea ming ledwith aspe raiona he begins oa follows la to the senate of cepres in congress assembled auh respect we represent f f iia the problem understood we think not what is it the mormon church ia made up of people who firmly believe that joseph smith was a prophet that frigham younie was his successor and that the priesthood of the church for the time being hold the keys of the kingdom are divinely commissioned receive y direct from the almighty hia will nd teach it to them under divine inspiration this priesthood is a thoroughly organized organised sed boly of men aa a rule of great tact and shrewd ness not liberally educated unpaid moving in ordinary walks of life in fact of the people like the carpen tere and fishermen of galileo the people are bimble minded imbres ignorant and in rude form deeply religious there are in utah and neighboring territories bay one hundred and fifty thousand old and young probably one hundred and 0 o t thirty thousand of them hi utah of priests eats and people it is no doubt cafe to eay abat eight tenths of the adults ara foreign born they hye come mainly from norway denmark england and wales the scandinavians are most y from abo manufacturing towns the poorest clasma cities the oain inz sections and obscure farming hi regions with few exceptions they are uneducated unintelligent corn people mr bennett boea on to say with truth 1 f they the as religiously r that smith was a prophet and hat what ho and the pro ae aro true as docs alie good eliat jesus is ay iy 9 VT the savior of mankind and that the teachings of tho christian priesthood anro alda to salvation they believe polygamy ordained aye commanded by the almighty alic person with and convicted of polygamy in their view therefore suu era religion if lie i the faith lie glories in ills punishment and tho body of alie faithful glorify liviu the stigma usually attaching to persona convicted of and punished for crime does not to him either in his own consciousness or in alie mand of hid fellow men thus the principal object of punishment fails in those cases continuing one would naturally suppose that the judge would con elude by recommending the repeal of the edmunds law but evident ly he is afraid to make such a recommendations as ho winds up the by advising that punishment for unlawful cohabitation shall not exceed five years in alie discretion of tha court and blank fine women to suffer the same aa men A sound mand would be guilty of no edich glaring inconsistencies ten cies proceeding to the consideration of the new edmunds ill mr ben pamphlet concludes that this latest proposition looking to the solution of our problem embraces some good and some bad provisions but no beneficent features the first section of this bill which provides that the lawful wife of a man charged jdith polygamy may be compelled to testify against her husband is rightly declared unwise and cruel continuing bis comments upon this subject the pamphleteer bays in prosecuting our aim should be to conserva conser the sacredness of wedlock between one man and one woman to protect monogamous the lawful marriage of a polygamist establishes such a household his lawful wife is queen of that household the common the sacred law of that household is blut neither shall be compelled to testily against the other and thus introduce discord into that sacred precinct but by thia provision it is proposed to remove this protection to invade this lawful home which is the very thing we BO much wish to protect it is cruelle cause deny it aa they may lawful wives of amista are wronged heartbroken women they will tell you with all the religious enthusiasm that they believe in polygamy that it 13 their cross which they must bear as the price of eternal exaltation could a comans womans heart more en proclaim that her comans womans instincts were violated yet under aliis provision she buet come into a public place and tell of lier own misery and licup convict a man to whom she plighted her troth still further elaborating his views upon the new edmunds bill the judge endorses those sections which provide for the attachment of witnesses without subpoena for the extending the time of dimita limita tion in polygamy and unlawful cases years for taking the elective franchise away from women for restricting the jurisdiction of probate courts for authorizing thor izing the attorney general to sue for and escheat to tho government all property of the mormon church in excess of in value and yet while endorsing all these provisions of the new edmunds bill he concludes rightly with amusing inconsistency that it only suggests vengeance ancs and does not breathe of charity and true re form he also very properly condemns those sections of the bill which provide that illegitimate polygamous children shall not ins hurit any property of their fa estate that trustees shall he ap pointed to take possession of and control the property of the mormon church and he thinks that the section providing for the seizure ol 01 the perpetual immigration fund would be dimply of no effect ic regard to the utah commission the judge concurs with the long since announced and often reiterated opinion of the mormon press that it is an expensive and vell nigh useless body from any point of view in various parts of his pamphlet judye bennett effects to desire to be politic wise moderate and hu mane by holdout hold iut up prominently the fact of the sincerity of the mor mons in their beliefs by deprecator ing vengeance by pleading indirectly for charity because the people are misguided fanatics but how does his policy wisdom moderation and humanity express itself finally why after this fashion he baye congress must govern utah direct and the delegate to Gon greis raut be appointed by the governor and court judges and he suggests that the following be embodied in new legislation a A te to to all applying for registration R voters debould be prescribed to the effect that ho person ia not a bigamist or or living in tho practice of unlawful cohabitation and does tibt to any association or organization which teaches advises or counsels the commission of those crimes b punishment for unlawful cohabitation dball not in bo discretion of the and alno women knowingly to polygamous marriages shall bo deemed guilty of polygamy and pun by imprisonment and alne same as men d women knowingly cohabiting polygamists shall he deemed guilty of unlawful cohabitation and punished by not to exceed years imprisonment and line e any one who shall by public or private advice or by spoken written or printed matter another or the public generally to commit the crimes of bigamy ur polygamy or unlawful cohabitation ahall bo deemed guilty of a felony and bo punished by imprisonment for a term of years and tine nut lcara than dollars congress should establish a freo common school system fur utah to maintain it the school land in htiu territory if possible should be placed in market and ahn funds realized from sales thereof to this purpose lest these funds should prove the act provide for moderate taxation fur alie purpose nothing sectarian should be taught in these schools and attendance of children undefined agea for certain terms should ba made compulsory g the people must obey lie law if they do net they mut be punished to this end congress should provide more liberally officers and money arr prosecuting offenders civil tion in the courts of utah is very large and with the numerous prose cution of polygamists the judges art overworked and civil business bufferd Buff eri there be two on appeals to the supreme court the judge who tried the case in the bourl below should not sit the salaries of alie judges should be instead of pel annum the lions for judicial expenses secret service paying witnesses etc should be largely increased so that work could be done in discovering offenders and bringing them to trial the government should construct a wholesome and commodious penitentiary tent iary the proposals that congress shall provide free schoola a new peni tertiary tent iary and the like are all well enough but on the whole judge brouett only proposes the establishment lish ment of a greater tyranny than has ever before disgraced american soil and this too he proposes in the name of republican govern As a pamphleteer judge begnett is a ludicrous failure |
