Show AN ORDINANCE to regulate the weber canal and the waters flowing through it and 1 to provide for keeping lie said canal in i SEC 1 be it ordained by the city council of ogden city that it shall be the duty of the city under the direction of the city council to superintend the weber canal and its branches and to have supervision and con arol of the waters flowing through them it shall be the duty of said to examine and report to the city council the first day of april of each year or at such other time a he may be required by the city council or the mayor of said city what re pairs are necessary to bo made on the weber canal and its branches or sub canals and the probable cost thereof including the water J masters compensation which shall be deemed a part of the expense of keeping said canal and its branches in repair he also report at the same time the probable number of farming land and of city lots that will during the year require water from said canal for irrigating purposes SEC 2 report of the 1 liaa been received it ahall bo the duty of the city council to determine tho rate of water tax to be assessed on each city lot or fraction thereof and on each acre of farming jand to bo irrigated from the eaid canal the owners of farming land or their tenants shall receive water for irrigation from the main canal into ditches of their own construction which they arc hereby required to keep in good repair the owners of city lots or heir tenant shall receive wa er for irrigation froid the main canalori can alor from any of its branched or sub canala which aro root conveniently and pay a pro rata proportion for keeping aha branch or sub canala in repair sed 3 persona desiring de to water from the weber canal for irrigation shall make application to the in writing staling the number of acres of farming land or city lota they wish to impale during the season and pay before the dayS next the amount 1 stated the city council arso to be assessed ami collected the shall nut distribute water to any who lias not coin plied with the requirements of thin section SEC 4 ache of taking the a provident provI deiT for the preceding section the shall to each applicant for water a written notice of the amount of water tax due from said applicant and stating thereon that it may be paid in labor on the ca nal at such time and place as shall be designated in said notice it said tax is not paid iu labor it must be paid t lie in on or before alic sah day of 1 torti provided that each slinia have at ic aai three das time and place labor on alio canal may be performed 1 he shall he paid labor aith antu of one dollar aud fitly wilts per duy for an ordinarily bood hand capable of doing a mans work 5 it shall be the duty of the to regulate the tune and amount of water each acre of farming land and each city lot shall ba entitled to aud he shall designate when each applicant shall take his barof the water if any applicant for water shall fail to pay the amount charged against him un his written application on or before the day of slay of eacle year the ahall not distribute any water to eaid applicant after that date SEC 6 if any person shall take latec from the canal or any of its branches at any time ex capt the same lias been duly distributed tri buted to lucli person by the ho shall be liable to r fine not exceeding fifty dollars passed april 1886 DAVID H attest mayor THOMAS J STEVENS SEAL city recorder I 1 hereby certify that the foregoing is a true and correct copy of an ordinance to regulate the weber canal and the waters flowing through it and to provide tor keeping the baid canal in repair passed by the city council den city on the day of April A D as of record in office witness my liand and the cor borate seal oily this day of april THOMAS J SEAL city recorder |
