who is known to have been tho author of the advertisement mr kiebel evidently wished to have it understood that his donation to the relief fund was purely a matter of charity and to wo his own words in to our piteous appeal to keep us from behind the prison bars he forgot that we made no piteous appeal except by the statement of facts showing that the editor had been guilty of no personal malice in the alleged libel affairs and claiming with reason that we were with partisan rancor and tried by a jury packed upon the open venire system with men wholly opposed to the defendant upon partisan ground sUnder these circumstances the conviction had no moral weight and tho charity of the public in paying our fine demonstrates thia fact in our opinion that mr fred J giesela Ki esela donation was a matter of charity wo cannot doubt but no one knows better than mr kiesel that men open their durees purees to betow charity only upon those who buffer unjust ly something Bom ething they are not able to bear and not upon those who are properly punished for crime no charily is exercised by intelligent men to screen offenders from the just consequences of their trans sione but where an individual is unfairly convicted of a misdemeanor mig aud a sen tance far too severe in alio popular estimation ho becomes a legitimate object of chi charity rity it would be only crediting mr kiebel with ordinary common sense to eay that lie un der stood and now understands this the circumstances justifying an act of charity perfectly well when he says therefore hia donation roust not be construed as an endorsement of our course he must still allow that it was intended as a partial vindication of the editor from the conclusions of the court that condemned and sentenced the writer otherwise if mr kiesel i exercised his charity to screen an offender from what ho conscientiously considered the just jus t and proper consequences of crime then mr giesela Ki esela friends cannot be too severe in their denunciation of him but there is no doubt at all but that mr fred J kiesel subscribed liberally to the relief fund from motives of pure and rational proper charity and the question naturally arises why he should take the pains at aliis late day to inform lie that his donation must bot be considered as an endorsement of our course let ua see if we can answer on the alth ot february a few days after mr kiesele 8 donation was made the following appeared in the columns of the salt lake tribune A gentleman who invested one dollar in the ilc rulief fund stated yesterday that be had naver invested a dollar that brought such i prompt returns before in hla life he declared that he had received worth of abuse from his friends evidently the anti mormon bull dozers were at work at their schemes of interfering with individual inde pen dence and coercing their dupes and factors we gave mr fred J kiesel credit for sufficient courage and manhood to dare to exercise hia charity forestall the abuse of his friends a the tribune puta it by alering that his donation mait not bo construed as an endorsement of our course though the firm was compelled to admit it intended to perform ao act of pure charity which all reason asserts could not haye been per formed except in the way of partially vindicating the editor of this paper from the judgements judge ments of the court
