summoned as jurors and the fact that they frequently biad to sell their warrants below par he recommends that arrangements be made for paying juror per diem and mileage in cash aud that the appropriation fur 1886 87 be made to the districts thus relieving the auditor from the responsibility lity of apportioning the amount the total deficiency 13 about in district in ihu second and in attic third he estimates that be required fur the coming two years exclusive of the deficit and says the is 80 per cent of the territorial revenue ho also states that there aro 1000 civil certificates section 9 which pro vides that the plaintiff who files a civil action must deposit a jury fee of 85 he moved to substitute by requiring the plaintiff to deposit 12 as a jury fre in order he said that the litigants should stand some of the expenses of the courts and in order further he said that litigation might be discouraged mr thurman drew attention to the fact that experience had shown such measures were ineffectual A man must under the constitution be guaranteed a jury trial whether in a civil suit or otherwise it would be found that the judge would order a jury whether or not there
