the united states circuit court it was an equity case in abo came of the attorney general of the united states against the kansas city lovenworth Leven worth south kansas rail company the bill wag filed january 1883 and alleged that the railroad company unlawfully held acres of land having obtained patents to lands to which it was not entitled these lands are in alien and are improved farms jonh several millions of dollars ardithe title tu lauy other lands are directly iivo d tho railway company claimed t f e lands under a transfer from the kansas texas railway company and that company by transfer from the atchison topeka santa feard alson by an independent arant for itself it seems that this grant to the atcha santa fe company required the company to build a branch down the neosho valley the grant was made on march ard 3rd 1899 the atchison topeka santa fe company instead of building the branch transferred its right todo so to the missouri kansas besas railway company afterward congress made a grant dated july 4 1866 to the missouri kansas alejas railway for the line down neosho valley the company built such a line but not as a branch of the atchison topeka santa fe company as required by the grant to that company judge brewer held that the atchison topeka santa fe company bould not transfer its right in the branch road and that even if it could the branch had not been built but an entirely independent line belonging to a different system the missouri kansas texas pacific company had attempted to get both grants while only building one road and judge brewer held that the second grant superseded superceded super ceded the first and the patents issued under the first grant to the atchison topeka santa fe company were void he further held that the company could not claim lands under the act of 1866 because it had made no selection under eliat act the decision is regards ed as a great victory for the settlers on the lands and there is great re joking
