"Nothing will be done In the contempt proceedings pro-ceedings against the Herald-Republican until after a Jury has been secured se-cured In the case of the state against James Hays. The affidavit has been prepared and will be filed at the proper time " This statement was made this afternoon aft-ernoon by District Attorney F. C. Loofbourow. after he had had a conference con-ference with Judge T. D. Lewis. Just what was said in tho conference Is not known excopt to the court and the district attorney. It L understood that tho reason for not filing tho charges at the present pres-ent tlmo Is that the district fttlornev wlshOB to secure a jury with as little delay aa possible. To date a total of over thirty men have been In the Jury box, with but two accepted. Counsel for the defendant de-fendant has exercised Ave of his fifteen fif-teen peremptory challenges and the stato bas used two.
