Show ARGUE MOTION FOR DISMISSAL Judge Kimball Hearing Pingree-Ogden Packing Arguments At 2 o'clock this afternoon, the arguments ar-guments on the motion for the dlsmls-I sal of the case of James I'lngree on cross-complaint, against the Ogden ! Packing & Provision company, began In the district court before Judge James N. Kimball Motion for dismissal of Plngree's suit was made Saturday by former Judge A. W. Agee, of counsel for the packing company. Tames H. L'cYlne, and J. A. Howell will assist Judge Agee In the arguments for the pack-IDS pack-IDS company, while H. H. Henderson j and Wade M. Johnson will oppose the motion. In the event that the motion is do- I nled the case will continue with the Introduction of testimony by witnesses for the defendant which will probably occupy the attention of the court for' thi remainder of the week at least. Tho action Is made by James Pln-grce Pln-grce to recover $421,000 In securities which he contracted to jjlve to the packing company to pay back the amount !n dividends which he was al- I leged to have received from the com-paiv. com-paiv. which.
