Show THE commission it at A county annl territorial election he be held in lit Migi august aho ano lint that lion win jennings lo be 10 dis franchised the following published iu in this mornings S liEt L rahl will explain itself SALT LAKE cm CITY june 13 alex kamlley Ram tey ley chairman of me commission Com lais an sin your committee a appointed p hinted on may etli to examine aal and report in relation to the offices to be filled at the august election in 1883 respectfully reports that there are to be elected members of tho the legislative assembly in all the legislative districts of the tile territory and also certain county and precinct officers As to those officers who should have been elected at tb the e august election in 1882 we wo find that by law some of them aro are to bo be elected for a certain number of years some for a given term and until their successors are qualified fled and until their successors are deded and qualified fled in regard to vacancies and the timo and manner of filling them tile local laws law s are arc difficult of construction in view of subsequent congressional legislation but in deference to alie decision of the supreme court of utah as to vacancies in the case caw of kimball vs RichEr Js in 1882 sustaining the appointment of the governor of utah we are of tile opinion that all offices which should have been filled at the general election in august 1882 are to be filled at the next general election in august 1883 for the term we e are lurther further of the opinion that tile offices of territorial superintendent of district schools territorial auditor of public accounts territorial treasurer and commissioners to locate university lands are under the organic act of the territory of utah to 0 o bo be appointed by the governor with tho the assent of the legislative council f and that acts of the Leeis lativa assembly providing for filling these offices by an election of the people are broin in conflict with said organic act and anti are thereby invalid re respectfully A B CARLTON 0 ij Go gourney irnEy committee t tito report was adopted and the follo following wim orde made matle that at it the general election to bo be held on monday august 0 1883 there arc are to be elected members of the legislative isla tive Ab in the several legislative isla tive districts of the territory and find also certain county and pre precinct cine t cere cers and that all county and precinct which should have been fille 1 il at the august election 1882 are re to be filled at vic august election 1883 for the time another official communication appeared in our salt lake namesake sake as follows ottee OF 01 ti till 11 COIN 91 LI LT L LAKE RE CITY utah mall june 13 sit fulani jennings Jennin gf esq DI sir sie I 1 have the honor lionor to tran transmit wit to you the following follow ing order of the corn com minion william jennings appeared before the commission on monday june 11 ISS Sand made the following follow ins statement 1 I 1 decided not to register lasty car but appeared nii Kared before the deputy I 1 llcy cg of the third salt lake cit cita precinct on oil saturday june oth th I 1 1881 M and took the oath prescribed b by rule 11 II of the rules defining ning the duties of tho tile re registration officers and was duly registered subsequently I 1 received notice from the deputy registrar that my name had been stricken from the list of voters of obeaid said precinct by the direction of thomas C bailey registration officer for salt lake count county I 1 entered into a polygamous relation prior to july 1802 1862 and continued in III that relation until about the year 1871 at which time my first wife died and I 1 have since lived and cohabited with but one wife 1 I therefore claim that I 1 leave not entered into any marriage relation in violation of law and that I 1 am entitled to have my name appear on the list of registered voters of said precinct and ask that the action of the he registration officer for said county bounty be reserved and my name restored to the list of loters of baid said precinct act after due consideration by the it ia is ordered that said eatn jennings lo 10 within tile meaning of 9 of the act ct of lf con congress ress bf march 1882 disqualified adias as ft IL voter and is therefore not entitled to register or vote i ARTi L THOMAS ii secretary of utah territory it is understood thai tha mr jen isings will contest this decision iu in the courts COUTIS 1 |
