missing letters and asked if lie wrote such letters describing them as indexed at the state department to the lie secretary of state it is my recollection I did lid tho the W witness stated lie added he biad expected to prepare copies of tho the letters alluded to but was unable to complete lete I them before ho lie left new york M he had bad copies of the letters in im his letter books and of all letters sent and received and could prepare copies but bill as some odthe letters were quite lengthy and he would naturally wish to look over and tind acomparo the copies lie might have made he lie would reneiro dire so somo mo further time rel tho 11 chairman mado made several se veril inquiries q ries in relation to the tile letters and asked if his subpoena did not require him to produce hie his books and papers Shin herd replied I was not anaro aware it did the witness produced the subpoena and read from it it required him to produce copies of all letters written by him to secretary blaino blaine under specified heads aleo alao copies copies of all letters written to secretaries t acs ics evarts and blaine between juno 79 and feb 82 also copies of letters written to any minister consul or other official of the united states re ferrine to the affairs of peru bolivia or chi Chili li or any matters of Iro property perty or business in ili which ho lie was interested in those united states conceivably ceiva bly there might bo be correspondence with w ith members of congress and other parties par lies and ho he was not quite clear whether the subpoena a was a intended to cover that ho ile further wished to know whether the intent was to call for all correspondence pon dence which might have passed mn between eon him and persons connected with the government or to limit to the correspondence touching chili chill and peru and finally whether if the latter only the committee desired all such correspondence rr or only such as referred to izi possible ble official action of the officials with whom he lie had corresponded ilice rice replied it was wass tho tile intention of th the co committee nimit tee that Ship berd should produce all the letters which he lie had received from that somewhat broad class of persons known as united states officials as m well as from all ill parties connected with tho the state department or other departments of the government the committee then went into secret session Ship berd and wife remaining in lit the room to determine whether t the lie witness should bo be permitted to return to new york personally to superintend the copy ot of the correspondence pon dence cal called ledfor for or whether theran an order should bo be issued directing the letter books to bo be forwarded to washington file committee in ili secret session adopted op t ed an order to the effect that ship herd be required to furnish the committee with copies of all correspondence dence addressed to any united states itt minister inister or official ot of the state department part ment touching the subject matter odthe of the inquiry also of all letters addressed to the witness and all correspondence j pon dence and copies of correspondence nee passing between botn cen the aforesaid wl which lich will throw light on the subject matter of the inquiry also all other correspondence and copies of correspondence pon dence in his correspondent and express the opinion pinion that there is a tendency to restrict the scope of ilic investigation Ship berd testified very pr promptly and intelligently and manifested an apparent willingness to give tho the committee the benefit of all his knowledge in asking ili what correspondence of his tho tile committee would want ho lie intimated quite plainly that he lie had letters from some members of congress and inquired if it the tile committee wanted these produced there was an immediate whispered conference among some of the leading members of ali tha committee tho the result of which was that the room waa was cleared for secret session the committee remained until it adjourned and there ther ewas was it is said an I n anim animated at discussion as to what
