signed P myer was duly sworn M and deposed I am 21 years of bagci age when at homo home I reside in brooklyn B roo yn NY I am a miner I am one on of the tile parties charged with stealing a box containing money checks w will da deeds ds ac from ambrose greenwell I am slightly acquainted with frank who is also charged with the same offense that I am I first came caime to ogden last M monday on the of nov 1881 I met fran frank k on the game day the witness here identified who was in court on his question where I was st stopping I told him lint I was stopping iti with M mr greenwell the witness liere here identified mr lie ile told me mr greenwell had bad a nephew ori cousin who wasa was a great it poker player told me that if I r was its a good poker player I could win lota lots of money of him lie he told mo me mr greenwell was doing a good business in the butchering but butchering cherin wholesale and retail said eaid he be had ad lots of money which ho lie must keep around the house somewhere he ile then asked askea if I would look out and see if there was any around there if I would lie would get away with it and give me one half of it that was all ho lie said on monday I saw him again the next day he then asked me if iliad I had seen anything saw him a again ain wednesday about p in when he be inquired again t if I saw anything I said an 11 no I was in mr Green wells kitchen on tho the mornin morning of the catin eating my b breakfast ast mr greenwell Green weli came into tho kitchen while iwas I was there and had a tin box with him I would know the box if I saw it again he ile identified the box produced in court by the prosecuting witness I dont don t know what he lie did with the tile box but he be took it into the front room I saw F P after that an on tho the same day after I saw mr greenwell with the tin box I was in the barbers shop next to mc are nutts butts about p in looked in through the window I went out when lie looked in he ire ask asked ed me what I was going to do today d I told him I did not know but but a I was going to dance he ile asked if I had ascii seen anything I told him I saw mr greenwell Green weli with the tin box and that ho put ut it in in the front room ho ile abkes asked if t liere was a bureau in tho the room I said yes he ile asked what kind of a key to fit the lock I said I thought it was a common key he ile then said lie would go and get some keys I then returned into the barbers sao shop to get shaved while I was in in t the Y i chair getting gettin shaved came into the tile s shop top he ile waited then until after I was shaved w when I len we went to mr greenwell Grcen wells I house over the butchers shop up stairs we went into the front room had two keys and tried to open all tho the locks on the bureau but could not open any did not fit there was a key fast in a small lock in the tile upper tipper drawer of the bureau ho ile unscrewed tic the lock and fook took out the key he ile then tried it in the middle drawer of the tile bureau which opened with that key when lie said I have got it he took out this tin box which has been heretofore referred to he ile lifted it up and felt of it and said it was very heavy he then went and louks dout out on the porch in front of tho the house and said the streets street sare are pretty quiet not many people eo le on them he ile then came each back and took in my overcoat which was lying on a mir chair put tho the tin box in my overcoat I told him lint he had bad better not take that coat when he said all right I then vent went out into tho the kitchen to get a button sewed on the sleeve of my shirt before I went there he told me which way ho lie was going I went into the front room put on my clothes and went down stairs I then looted around to see if I could see but could not sec see him I then went as far aa as the first corner west of G s shop where had bad told me he lie was ring going I went one block north an and saw oatlie the U N railroad about ono one block northeast ot the iron works I went in the brush where was I sat down in the place where he called me clethen took out a black handled pen knife from his pocket and cut open this tin box the way it is now there was no opening i in a it before he cut it he ile took aal ail th the e m money oney and papers out of the box he shook the tile papers to see if then was any money in in them then he hoa piled up the money 20 and 10 gold pieces the tile bills and paper money he put in separate piles he then handing me some money said that is for you on and and bury it as I was a st stranger and knew nothing not liing of the place we then walked back along the track lie ile went down to a telegraph post took out the same knife and and cut a willow stick with which he be began to tc dig beneath beneat li the telegraph post after he dug the hole chiv hiv he saad a i d give me your money I took i it t all and put into this kerchief ho ile buried the handkerchief and the money after which we went up the tr track ack toward the town when I got as far ai a i a ditch near the iron works I had a key in my hand I said I dont want this and threw it into the stream ani he ile said that is a fine place to throw that I said saidi I care we walked a little way further when he said my aly money jingles I roust must bury it ho ile then told mo me I must not be teen with him ho he said I had better skip the country I said no I will stay he ile said it is a terrible pressure if you think you can stand it all alit right we then walked along the railroad ro ad towards town whence when we got gok a block south of the iron works work ii lie he told me to go east and he be would go along the track if not some one would see us together I crossed off the railroad track northeast corner of second and wall streets and was crossing crOSSi Dg tile street to the block when he lie said dont come with me go that way I then left him and went to MeN mcbutts utts ts billiard hall all that I have now related took place between a little after p m until sundown the stick that cut was about 18 inches long and slanting at one end the inife with which lie cut it waa was a black handled one four or five inches long I would know them if I were to see them the knife and stick were here produced and identified by witness cc tile knife is the ono one with which cut the tin box which contained tho the money and which was buried the stick is the one with which he dug the hole after cross examination which elicited nothing new the court adjourned till tuesday morning 10 in the court house TUESDAY nov 2910 29 10 a in the court matthis met this auant to adjournment and the examination of witnesses in the thle greenwell robbery case was resumed the first witness was il H spence who being duly sworn said I am 29 years old reside in ogden 11 city am bookkeeper to mr david eccles I am ant slightly acquainted with the defend defendant arit frank I saw him on the of november 1881 about halt past three in the afternoon as I was coming comin from f born the direction of the iron ai works r ks on the utah northern railway track between ae bo bridge and the old iron works off icea short distance north of first street ho he had a bundle carrying carrying under his arm arin which appeared eared tobe to be a bundle of cloth clothing ling re the bundle was on m the right hand side of him l was on ilic left I recognized him him at at the tile time I saw him he lie was going ng in in a northern direction on oil the UIN U N R E R track the defond ent is now in court frank is the same person I saw the witness identified him I know the defendant myer I saw him on this day following but at that time I was not acquainted with him but after I saw raw I recognized him as the man both were going north of the utah northern R X it but not on the track was going north was not then on the tile track but both were going in the same direction about rods apart in his cross examination witness said lie was about rods from defendant fen dant when he first saw him witness was standing by some old castings about 80 feet west wast of the track was wels positive that frank was the man lie saw he had on a dark coat was not sure it was an overcoat the bundle tile defendant carried was either of dark color or the coat wag was thrown over it so as to give it that appearance the bundle appeared to bo be about three fouchs of a cubic foot in size first mentioned this matter to air mr chapman about on friday evening was told by chapman that frank and a young man who had bad been boarding with mr greenwell were accused of stealing mr Greenw Green dla wells money and they had both been arrested witness said it seemed strange for he had seen and another young man whom he be did not know going goin north on the U N track north of 1st ast street the evening before oscar vandercook being duly sworn am 33 years of age am deputy U S marshal mide in ogden city U T I was present when mr A greenwell green well found some mone money buried in in a handkerchief on the U utah I h northern railroad about half a mile north of the iron works beside a telegraph pole east side of track this was on last the it waa was wrapped up mo in a white cotton pocket handkerchief it was buried about leu ten inches under the ground the amount was in gold coin and greenbacks green backs thero were 11 20 gold pieced 10 gold pieces gold pieces in currency there were g 20 bilk bills 65 bilk also found a stick piece picco of a willow about ono one foot long it was cut an and d evidently e videna used for dicing digging a holo hole to bury this money stick was produced and identified by witness I gaw saw tile knife that was bestif testified led and fled by in court yesterday I was informed where to find the mone money by myer defendant in this case jas at brown duly sworn said I am 46 yes ye s old live in ogden city am a policeman q since tho the arrest of F frank rank I was pro sent on the irist when ulle ivare ahna ma koves searched him he ile found a pock knife on his person described mgt d th the e knife which corresponded with that given by other witnesses ki knife nife produced and identified ti fied DEMME george deposed I am 41 years of age reside in ogden am a carpenter he said I met the defendant fen dant daut frank on oil the morning of the dinst bentio went to gibsons gibbons Gib sons lumber jard yard between and I met F frank ra on n main alain street between and k am from the time we were together on slain main and I never lost sight of him except for about half an hour until about 10 minutes to in the afternoon I saw him last near MeN mcbutts utts ts if I remember right no cross examination richard duly sworn said I am 43 years old reside in ogden city am a carpenter by trade I dont know exactly what time it was when wo we left jacksons house but the tile folks were comin coming from meeting we stopped for and found frank still there I left him there and did not see him again till about half past four or five at my hou bouso o the cross examination of this witness brought forth no essential points and
