Show Suit to Recover on Note Starts Today The case of the Consolidated Wagon Wag-on and Machine company against Jo-soph Jo-soph Barker, in which the plaintiff company Is suing to recover $1232 3t alleged to be due on a note, began in Judse A. W Agee's division of the! district court this morning. The company com-pany claims that on January S. 1912' the defendant delivered 'i promlasory note for J1708.5O and sln s that time haR paid but 640.S0. Judgment for the balance, interest and attorney s fees are asked. In answer to the complaint Harker admits to , have made the note, but claims that at the time of execution he delivered certain other notes to! the plaintiff for collection. Ho sets forth If those notes had li-en collected by the plaintiff company. the full amount of tho note would now have-been have-been paid. F'or this reaaon, Barker claims he Is In no way Indebted to plaintiff and asks dlsmtsal of the suit. |
