Show legal elniE 01 OVER UP UW A pile of- law books which almost covers the entire top of a big table in Judge A. W. Agee's" court room is the fortification behind which City Attorney Attor-ney W. H. Reeder, Jr., and Assistant City Attorney David L. Stine have entrenched en-trenched themselves fo uphold the validity va-lidity of the special statute passed by Ogden city last September, under which Juan Zamata was arrested and convicted for bootlegging. The city attorneys declare that each book con-i con-i tains plenty of proof that Ogden city's commissioners had the right and power pow-er to pass such a law, for each has a record of instances where similar action ac-tion has been taken by cities in various va-rious parts of the United States. Attorneys Sam Powell and J. A. Kimball are representing Zamata and have sued for a writ of habeas corpus, basing their petition on the assertion that the special ordinance is Invalid because Ogden city did not have authority au-thority to pass it. Zamata is serving a six months' sentence in the city jail for bootlegging. nn |
