Show JURISDICTION LOST BY THE I BOARD At the meeting of the city board of commissioners today ICnglueer H J. Craven communicated to the board that Jurisdiction has been lost In the matter of placing concrete paving on Washington avenue south from 34th street, notwithstanding that the cltj has already declared It had jurisdiction jurisdic-tion and the engineer had advertised for bids for the improvement The engineer recommended that the action of the board of March "' be reconsidered and the advertisement for bids be recalled. The recommendation recommen-dation was adopted. The reason for the change is that the engineer received a letter of protest pro-test from II Metsler of Ixjs Angeles, who owns something over two hundred hun-dred feet of real estate abutting tho prDpi k ' I pa ving d.ited Ma rch -7 i vv o days before the time of final accounting account-ing on tho pan of property owners protesting against the paving This brought the percentage of protests to 71 44. causing the city to lose juris diction The engineer and the commissioners com-missioners took tho position that even though the protest of Mctzler did not reach the commissioners until after the date of final protest, the letter making the protest was dated March 27 and that It should be considered It also appeared that James Green well had been negotiating for the Metzler property and that on the strength that tho deal would bo closed bad protested for that property against the paving proposition, but his protest was set aside as ont being leunl Now, in thj fao of the tact that Mr Greenwell has virtually pur Chased the property and that both he and Mr Metzlor do not approv e of the plan to pave the avenue with concrete it has been considered fair to abandon the paving project |
