Show G OF E 1 PAC T mrs rice star witness 1 for the state testifies omaha dec 2 when the trial ot of charles E davis charged with the murder of dr frederick T rustin was resumed today the cross examina tion of mrs rustin widow of the victim of the tragedy was continued again the court room was packed mrs abble rice the star witness for the state followed mrs rustin to recite in court for the fifth time the story of her life and the suicide agreement with dr rustin which only lack of nerve prevented her carry into ef feet it was the policy of oe the defense to secure the exclusion of all that portion of mrs rices story tending to cast suspicion upon the defendant in th the I 1 present trial and in effect t to destroy athis this endeavor of the croos examination to create in the minds of the jury the question whether or not net sirs airs rice did after all fire the fatal shot or make away with the pistol after dr rustin rustan had shot himself in her presence when court opened attorney gurley curley for the defense asked mrs rus r tin to produce certain insurances on ithe I 1 the lifee life of her husband she said her i lawyer had them and would produce them mrs rustin said she recal recalled but two ahro nights during the two weeks from tho the time of her return from si a visit out of town until the night of his death when dr rustin was at home all night the desired life insurance poll policies clev had been brought into court and iden rifled by br tho the witness it was proposed propos ec by br the defense to show that the pol pel ides acles contained provisions making them incontestable except for abu non pay ment of premi premiums unis the prosecution objected to introducing this matter as a MI cross croes examina tion so it was deferred dr millard langefeldt who was a neighbor of dr rustin and was called by mrs airs rustin soon after the shooting of her husband testified tho call came approximately twenty minutes of at four iio he said that although ho he had never heard her speak before ho he received tho the impression that it was mrs austill talking he could not account for the impression after describing tiie tie condition in which he found dr rustin he be said 1 I asked airs rustan how did this happen and she answered that sho she aicard a shot and found her husband outside nothing more was said bald on the he noticed that the pupils of dr custins Rustin Rus tins fi eyes were contracted suggesting he was under the influence of morphine during cross examination the defense defenso tried to bring out that from motives of delicacy the witness refrain ed from inquiring into the circumstances of the shooting at the cle time but i the objections of the prosecution were sustained A question as to whether the wound could have hava been self inflicted was also ruled against |
