representatives and the state senate was started yesterday afternoon when resolutions were introduced in the hause of by representative thompson severely criticizing the senate in not passing atie resolutions congratulating the united senate for retaining rcck smoot and alao sending congratulations to senator smoot on his victory the re mada a bitter attack on the action of the senate the resolutions were read and U was moved and seconded when representative senta tive crutchlow secured abo floor ho wanted the phrase that the senate was unpatriotic an d discourteous stricken out he declared that he thought that the senate should receive the same courtesy at the hands of the house representative bobus declared that he was in favor of the resolutions going through as they were neph jensen then sprung a surprise by ashing that the consideration of the resolutions go over until 3 wednesday representatives and spoke strongly against the resolutions which were as follows i whereas on february 20 1907 f duly authenticated telegram was re calved from washington D C con beying the that the riall of the honorable reed smoot to his seat in the senate of the united states as senator from utah had been confirmed by the united states senate and whereas upon receipt of said information the house of representatives of the state of utah being in session did under suspension of rules and by unanimous vote pas a resolution to alt house faint resolution no 5 by mr thompson expressing he appreciation and congratulations of the people of the state by its authorized representatives the senate and house of representatives in the state legislature to senators smoot sutherland and other senators who hodar valiantly stood for constitutional rights of the people of utah against tremendous pressure and whereas said joint resolution haying passed the house of representatives was immediately forwarded to the senate of the state of utah then in session and ahat a motion was thereupon made to suspend the rules of the senate and pass said resolution which motion met with violent opposition frona certain 1 state senators that the motion to suspend the rules was withdrawn and a motion that the resolution lie on the table for one day was carried and whereas on the following day to wit february 21 1907 no action was taken by eliat honorable body fo take said resolution from the table and give it consideration and whereas the said resolution expresses the sentiment of a great majority of the citizens of this state irrespective of creciTa nd national kolii party affiliations and that the unpatriotic and discourteous action on the part of the honorable state senate has prevented the people through its representatives the legislature of the state of utah to promptly convey its appreciation and congratulations to thoe moat interested on the termination of a long fight against senator reed smoot in which the state of utah has been subject to the most unwarranted and unjust censure and whereas ohp best results io legislation pending before this legislature can only be attained when harmonious feelings between the coordinate branches of the state legislature and the people of the state and in order that such desirable harmony may be more firmly established and maintained therefore be it resolved that the honorable senate of the state jot utah be and Is hereby respectfully requested to recede from its unpatriotic and discourteous position in regard to house joint resolution no 5 and either by passing the same or by giving the house sufficient reason for its failure so to do of the apparent contempt for this honorable body and the people of the state of utah and be it further resolved that resolutions be spread upon the journal of the hoube and a copy thereof forwarded to the honorable senate of the state of utah for their consideration communications were received from the senate announcing that the senate refused to concur in the amendments by the house to S B no and a conference committee composed of representatives jackson thompson and was appointed to confer with a like committee from the senate A communication announced the passage of S B no 93 by hollinge worth it was referred to the committee on judiciary S B no which is a substitute for H B no 51 was declared passed by the senate and was referred to the judiciary committee in the absence of speaker joseph who Is still on account of the tragedy at bingham H J F a democrat was placed in the chair A report from the memorial committee announced that the memorial services for representative seth taft and clant B leigh man would be held at tuesday february 26 1907 in the house of representatives chamber the senate Is to be invited to take part in the services during the session A strong attack was made on house bill no 41 by giles it provides for the creating of new counties and was overwhelmingly defeated the attack on ohp bill was made by kuchle r in part he said owing to elarge th area embraced in many of the counties of this state it Is to be expected that sooner or later it will be advisable to several of the larger ones into one or more smaller ones in most staler f i 1 tile power to doi this is given direct to the legislature but the peculiar provisions of our constitution forbid the changing of county lines in any manner except by direct vote of the inhabitants thereof section 3 0 article XI provides no territory shall be stricken fronir any county unless a majority of the voters living in such territory as well as of the county to which it is to be annexed shall vote and then only under such conditions as may bo general law so that the only manner in which a new county may be created in this state under the constitution is by vote of the inhabitants under such conditions as may be prescribed by general law this bill is general in its scope and Is intended to apply to any county in the state the inhabitants of which may desire for geographical reasons or otherwise to cut off a portion and form a new county it Is prepared so as to protect both the old and the new county by providing that no county shall be divided it such division will leave a county smaller in taxable property than alie twelfth class or if the county to be created will be smaller than the twelfth class A new county cant be formed under this bill it it becomes a law without the consent of a majority of the voters of the entire county nor can a county cut oft a portion of its territory without the consent of a majority of the voters of the district to be cut off wo now have a statute providing the manner of annexing one county to another laws 1901 P and another providing the manner of annexing a portion of one county to another laws 1903 p we should also have a statute relating to the creation of new counties the house passed the amendment to H B no 27 by robinson as made by the senate and the bill was passed the house also passed H B no 99 b y hone requiring all corporations to pay an annual state license it alao provides the amount of license IN THE SENATE the senate committee on education yesterday reported on the university agricultural college consolidation bills without recommendation and asked that they be made a special order for monday march ath at 10 a m A motion to this effect was carried and the big fight of the present session will occur that day two of the bills nos 34 and 25 by bullen of cache provide for separate maintenance of the institutions tut ions while senate the same were passed without opposition considerable discussion was caused by house bill no 19 by robinson raising the salaries of the state board of equalization from to 1500 senator miller wanted to amend by inserting a section preventing the equalizers from accepting passes or other gratuities from companies or corporations which they are called upon to assess senator lawrence supported the amendment saying that he deemed it improper for any of the members of the board to be under any obligations to these companies 1 I would like to see this antipass anti pass idea extended further he said senator of ogden in the course of a speech opposing the amendment said 1 I dont favor this propos eed change it seems unfair to me to single out the board of equalization I 1 take the ground that any man who is influenced by passes and such gratuities Is no good anyway and this amendment wont help things why dont we pass a bill doing away with all passes I 1 have a pocket full of them and a drawer full of them home I 1 have had them for years but I 1 do not consider that I 1 am any more entitled to them than the board of equalization iza tion make this amendment more sweeping and apply it to everybody and I 1 will vote for it the ogden states mans views prevailed and the amendment was lost by a vote of 11 to 6 senator gardner then moved to amend by abolishing one at the commissioners ners and making the board consist of three instead of four members this was carried by a vote of 9 to 7 the bill was then passed by a vote of 14 to 3 those voting in the negative being senators johnson and president love later on in the session senator walton discovered eliat the bill would have to be amended in other particulars to conform to the gardner amendment and secured a reconsideration it will come up again at 3 this afternoon action was postponed on senate bill no and house bills nos 31 and 45 and house joint memorial no 6 the report of the committee on education
