frank crocker Crock cr ct al inter lenors judge howell has handed down his decision this is the case of the A 0 U W clodgo funds in which after the order ceased in this jurisdiction to exist as a beneficiary organization several widows wives of former members sued for their funds twenty thousand dollars va s placed in the vault of the first national bank awaiting the decision of the court the money is ordered divided among the beneficiaries fici aries after a review of the case judge howell gave the following decision it is therefore ordered adjudged and decreed that the persons per sois named on the tabulated list hereto attached as the beneficiaries of the deceased members whose names appear on said list are entitled out of the funds now in the hands of the county treasurer in pursuance of the order of alie court to the amounts set opposite their nimes and if after the findings of fact conclusions of law and decree aio made in accordance herewith no appeal be taken the said county treasurer is authorized and directed to pay out of the moneys in bis hands the said sums to the said beneficiaries or their attorneys of record receipts for the same except that he Is directed to retain in his hands until the further order of the court the sum of the amount to which the beneficiaries of james W pitts are until such time as the court shall determine to whom the said sum died during october arc en tiled to an equal distribution of the funds because none could have joined the supreme lodge jurisdiction until november even had they so desired this includes all the defendants except matelson Mat hlson who discontinued his membership after having had an opportunity to renew it |
