Show HOLDUP HOLD UP MAN FOUND GUILTY james convicted of daring holdup hold up in the onyx bank salt lake sept 19 james was found guilty at yesterday afternoon of holding up the onyx bank saloon conducted by james Mc Temey on the evening of may 2 last with two partners and relieving thomas B needham bis bartender and J J burke and james G calr of 1100 in jewelry and money the jury in the case which was hotly contested went out at yesterday afternoon after bearing judge armstrongs Aim strongs charge the state yesterday sprung a surprise on the defense by introducing as a witness thomas J taylor a fellow prisoner of mckemey at the pocatello jail where he was lodged after being arrested at mccammon ida the day after the holdup hold up taylor testified that he was serving a three months sentence for a petty crime and that mckemey told him that he had some diamonds hidden at mccammon and wanted to get out and secure them afterwards taylor said that gave a jail trusty 10 with which to purchase a revolver for him and the next day gave the trusty 20 more in order that williams and taylor could both have revolvers williams being neya daltner at the time of the arrest the deal fell through however as the trusty took occasion to hocamp on the next train with the 30 and the authorities have not been able to locate him since the defense succeeded in casting some discredit on the testimony of thomas B necdham when he was re called to testify in their behalf previously had declared that he had not identified any other man but as the holdup hold up artist when asked by counsel tor the defense yesterday whether he was sure of this he replied that he was it developed through a newspaper clipping to which needham was referred that he bad identified a man by the name of matthews the day after the affair in a saloon conducted by nick tedesco as one of the trio of robbers when confronted with this evidence needham backed down and said that ho had not understood the question previously put to him georgo conly bartender at the te bosco saloon corroborated the acs bense in its contention in order to cast doubt on taylors story the defense recalled deputy sheriff mcgarvey of pocatello who swore that he had searched when he wag arrested and found no money on him the closing address to the jury on behalf of the state was made by frederick C loofbourow district attorney while dameg T hamilton spoke for the defense will appear for sentence on sept |
