Mrs. Grow 1b asking for damages In the sum of $25,000, tho facta alleged being that while lu tho employ of the company In 1010 Mr. Grdw lost his llfo through tho careless and rcck-lo8s rcck-lo8s operation of a train of cars by tho agents of the defendant company at a point near Mora Siding, Idaho. Tho complaint avers that Mr. Grow was engaged In tho erection of tho "block signal" Bystem for tho railroad company and that on January C, 1910, In moving from one point of operation opera-tion to another In a motor car, operated operat-ed by ono John N. Orr, foreman for the company, ho was run down by a passenger train and killed. It Is further fur-ther Btaled that the train was beino; run at tho rato of Boventy miles an hour nnd that no sound of warning was given by the engineer, nor was there a hoadlight on tho engine The motor cor was thrown from tho track and Mr. Grow instantly Wiled. Mr Grow Is survlvod by a widow, tho plaintiff In this action, and four chlldron ranging in ages from 3 to 10 years. Tho suit war, Instltutod soon after the accident, but has not beon brought to an Issue until this time because of tho pendancy of a case before tho Bupromo court of tho United States rogarding tho law of liability respecting master and servant. serv-ant.
