The defense contended that the chaige of cruelty to animals would not hold, on the ground that a turtle was not an animal, but a fish. Professor Robert YerkeSj of Harvard, Har-vard, witness for the prosecution, declared de-clared that turtles are more nearly related to birds than to fish. On cross-examination, Prof. Ycrkcs said that there was a difference of opinion about the cruelty of the act, ' but admitted the necessity of either placing a turtle on Its back or in f water If It was to be kept alive. |
