Show LAWYERS IN A WAR OF WORDS The Murray damage caso has at last been submitted to the Jury, tho arguments argu-ments by the attorneys having been concluded this afternoon. Rebuttal testimouy was given this morning and Judge Howell gave rather lengthy Instructions In-structions to tho Jury, touching upon the different phases of tho litigation. YeBterday afternoon Attorney J. B. McCi-acken, for tho plaintiff, was placed upon the witness stand to impeach im-peach Witness Wlgstaff for the defendant, de-fendant, which furnished Judge King for tho defense an opportunity to give the attorney a severe grilling regarding regard-ing the Interest ho and his associate. Judge Agee, had in the case. Tho attorney at-torney for the canning company asked Attorney McCrackcn whether he and Agee were not paying the expense of the prosecution of the case upon the contingency that thoy should not receive re-ceive remuneration unless a'Judgment for the plaintiff should be given by the Jury, to which Mr. McCracken replied re-plied In the affirmative. He qualified the statement, however, by saying that tho plaintiff had furnished somo 'money for costs, incident to the beginning be-ginning of the suit. This morning the time of the court was taken up until near 11 o'clock hearing rebuttal and sur-rebuttal testimony tes-timony and listening to heated contentions con-tentions on the part of the attorneys regarding tho admissibility of certain testimony The attorneys became excited ex-cited at times, tho Uo being passed and tho court being compelled to advise ad-vise the lawyers that unless tho call ed off tho war of words and of personal per-sonal innuendo that he would impose fines for contempt In tho cross-examination of James Murray, who was placed on tho stand to givo rebuttal testimony regarding the Instructions, Manager Pierce, of tho Canning company, had given to the boy plaintiff, in respect to tho danger of climbing a ladder leading to tho machinery which caused tho In jury to the plaintiff, Mr. Agco questioned ques-tioned Judgo King's motives In pro pounding the questions- The latter advised tho former lawyer that he was telling an "untruth," further emphasizing em-phasizing the stalomont by saying that he might use "tho shorter and uglier term." Agco resented the imputation im-putation and tho attorneys for awhile talked of taking care of each other without aid or suggestion from tho court The matter was dropped when the court advised the men that, unless un-less the merits of tho case were given more attention and fewer personalities personali-ties Indulged in, the court would use its strong arm In a short sentenco for contempt. |
