Schlllo, the defendant, In an answer and counter claim, alleges that the plaintiff plain-tiff Is indebted to her in the sum of $250 as n balance duo on n certain ante-nuptial promissory note. Mrs. Schlllo states that she married tho plaintiff at Cloveland, Ohio, Nov. 15, 1907, the consideration being that the plaintiff pay her $1,000 on demand. de-mand. It waB also agreed that the plaintiff pay tho $1,000 by depositing in the bank from time to time such sums as he could wel afford, until the money was all paid it Is further alleged al-leged that the plaintiff uttered a certain cer-tain promissory note for this amount, and that the $300 which the 'plaintiff alleges she wrongfully took frpm the bank heretofore, was rightfully her's under tho terms- ot the- ante-nuptial agreement The defendant states that, soon after aft-er tho marriage, the plaintiff became cruel and unkind to her, oven being Inhuman toward her at times. Sho commenced divorce proceedings against him but he Importuned her to withdraw tho complaint promising that if she would, ho would bo more kind and would treat her as a wife should be treated by a husband Sho yielded to his porsuaslons and returned re-turned to 'him. But tho husband soon became dissatisfied and filed a petition peti-tion for divorce, charging her with desertion. She denies tho charge and assorts that, on the contrary, she left homo with the plaintiff's knowledge and consent She Is willing to release re-lease the plaintiff from the bonds of matrimony If tho court will decree th?.t sho bo awarded the $250 now In tho bank. |
