Show SS SUING FOR DAMAGES OF $20,000 In Judge Howell's division of the district court this morning, the caso of Mrs.'C. Grow against the Oregon Short Line was called for trial, tho jurymen for the May term being on hand, but, following a conference between be-tween the attorneys and the court, it was determined that tho hearing shojid be continued until the June term of court. A question of interstate law is involved in-volved in this case and it Is understood under-stood that tho supreme court of the United States will render a decision touching on the question May 29, and it was thought best to not try the Issue Is-sue here until after the supreme court ruling has been handed down Mrs. Grow is the widow of Cyrus L. Grow and administratrix of his estate. es-tate. In her complaint sho alleges thnt while her husband was in the employ of the defendant company, at Mora Siding, Idaho, January 5, 1910, he was run down by a fast moving train and killed He was employed on the "block signal service" for the company, under the direction of Foreman John N. Orr. In the discharge dis-charge of their duties they were using us-ing a motor car, and, wh.lo in the operation op-eration of the car, a passenger train, hauled by two locomotives, came along, giving no signal and having no headlight on the foremost engine to guide tho engineer in his duties. The passenger train struck the motor car and Mr. Grow was hurled to his death. Mrs. Grow was left a widow with a family of children. She asks damages dam-ages In the sum of $25,000 and Interest Inter-est on that amount from the date of the accident, together with costs of suit. |
