Show ORDINANCE NO an ordinance gra granting afi g to utah power light ligh t company unta n its successors es and a assigns igns an electric 1 transmission line franchise be it ordained by the city C council oun of morgan C city ty s section 1 that there is hereby granted to utah power light company its successors and assigns herein called the grantee the right privilege or franchise until sept 8 1997 1097 to construct maintain and operate in in the present and future streets alloys alleys and public places in morgan city utah and its successors electric light and power lines together with all the necess necessary ary or desirable appurtenances including underground conduits poles towers wires transmission lines and telegraph and telephone lines for its own use for the purpose of supplying electricity to said city and to persons and corporations beyond the limits thereof for light power a and nd other purposes but the grantee shall not no acquire acqua acqui re any rights hereunder to furnish electric service to any of the consumers within said city except those now being served served nor shall the grantee acquire any right hereunder to construct and maintain any line in in said city except those already constructed and a transmission line over and along the following described center line beginning at west incorporation boundary 0 city at east bank of east canyon creek at a point feet south and 2233 2235 feet west more or less from the northeast corner corne r of section 2 T 3 N R 2 E S L B dr thence running N 66 15 E 2339 feet to a point west of field street thence S NO 53 E feet and across field street to the south side of spring street thence N GG fg 25 2 E feet along and 12 feet more or less from the south side of spring street thence N GG fig 0 2 25 E feet more or less across and to the north side of spring street thence S SG 66 39 29 E feet more or les less along the north side of spring street and to the east incorporation boundary of city at base of a mountain ridge sec 2 poles and towers shall be so erected as to interfere as little as possible with traffic over said streets and alleys the location of all poles towers and conduits shall be fixed under the supervision per vision of the city council of the city but not so as unreasonably to interfere with the proper operation of said lines see sec 3 all lines constructed under this grant shall be constructed in in accordance with established practices with respect to electrical construction see sec 4 the city shall in no way be liable or responsible for any accident or damage that may occur in the construction operation or maintenance by the grantee of its lines line and appurtenances hereunder and the acceptance of this franchise shall be deemed an all agreement on the part of said grantee its successors and assigns to indemnify said city and hold it harmless against any and all liability loss cost damage or expense which may accrue to said city by reason of the neglect default or misconduct of the grantee in the construction operation or maintenance of its lines and appurtenances hereunder sec 5 the grantee shall file its written acceptance of this franchise with the city recorder within thirty 3 30 10 days after its passage sec 6 1 this ordinance shall take effect as soon as it shall be published as required by law deposited and recorded in the office of the city recorder and accepted as required herein passed by the city council of morgan city utah this eth day of september 1947 F L PARKINSON mayor SEAL attest GOLDIE WALDRON city recorder state of utah county of morgan ss I 1 the undersigned undersigner under signed the duly qualified and acting city recorder of morgan city utah do hereby certify that the foregoing consisting of two pages is a full true and correct copy of an ordinance adopted by the city council of said city at a meeting duly held therein on the ath day of sept 1947 IN WITNESS WHEREOF I 1 have hereunto set my hand and affixed the corporate seal of said city on this the bah day of sept 1947 GOLDIE WALDRON city recorder SEAL date of publication september 12 1917 |
