R No 7 I By Hopkins 4 1 It J Gunther r p Welch Velch and Sheffield i A JOINT RESOLUTION PROPOSING PROPOSING PROPOSING PRO PRO- POSING TO AMEND ARI ARTICLE ARTICLE AR- AR I XIII SECTION 2 OF I i 1 THE CONSTITUTION OF THE STATE OF UTAH REt REI RE- RE t I 1 LATING T TO 0 TANGIBLE I PROPERTIES EX EXEMPT E M P T FROM TAXATION Be it resolved by the Legislature Legislature Legislature Legisla- Legisla ture of the State of Utah I i two-thirds two of all alt members J i elected to each of the two I houses voting in f favor a v 0 r hereof thereof Section 1 It is proposed to amend Article XIII Section 2 of the Constitution of the State of Utah to read as follows I Section 2 All tangible property property prop prop- V erty in the state not exempt under the laws of the United States or under this constitution constitution constitution tion shall be taxed in proportion proportion proportion tion to its value to be ascertained ascertained ascer ascer- tamed as provided by law The property of the state counties cities towns school districts municipal corporation a and n d public libraries lots with the buildings thereon used exclusively exclusively exclusively for either religious worship worship worship wor wor- ship or charitable purposes and places of burial not held heldor heldor or used for private or corporate corporate corporate corpor corpor- ate benefit shall shaH be exempt from taxation Water rights ditches c can canals a n a l Is s reservoirs power plants pumping plants transmission lines Imes pipes and flumes owned and used by in individuals individuals in- in inV V or corporations for irrigating land within the state owned by such individuals or corporations or the individual members thereof shall shaH not be separately taxed as long as they shall shaH be owned and used exclusively for such purposes Power plants power transmIssion transmission transmission sion lines and other property used for generating and delivering def delivering de de- f livering electrical power a portion of which is used for furnishing power for pumping water for irrigation purposes on lands in the State of Utah may be exempted from taxation taxation taxation taxa taxa- tion to the extent that such is used for such pur pur- poses These exemptions shall accrue to the benefit of ot the users of water water- so pumped under such regulations as the legislature may prescribe The taxes of the indigent poor may maybe maybe maybe be remitted or abated at such times and in such manner as may be provided by law The legislature may provide for the exemption from taxation of homes homesteads and personal personal personal per per- property not to exceed 2000 in value for homes and homesteads and all aH household furnishings furniture a and n d equipment used exclusively by bythe bythe bythe the owner thereof at his place of abode in maintaining a ahome ahome ahome home for himself and family Property not to exceed O OIn in value owned b by disabled persons who served in n any war warin warin warin in the military service of the United States or of the State of Utah and by the unmarried wIdows wIdows' and minor orphans of such persons may be exempted as the legislature re may provide The le legislature shall provide by law for an annual tax sufficient sufficient sufficient suf suf- with other sources of ot revenue to defray the estimated estimated estimated esti esti- mated ordinary expenses of the state for each fiscal year For the purpose of paying the state debt if any there be the legislature shall provide for levying a tax annually sufficient sufficient sufficient to pay the annual interest interest interest inter inter- est and to pay the principal of su such h debt within twenty years from the final passage of the law creating the debt Section 2 The secretary of ot state is directed to submit this proposed amendment to the the electors of the State of Utah at the next general election in inthe inthe inthe the manner provided by law Section 3 If adopted by the electors of this state this state this amendment shall take effect the first fast day of January 1959 |
