Show OPEN LETTER political advertising dear editor for the benefit of the voters ot of your section of 0 the fifth judicial district I 1 desire to express through your paper the reasons why I 1 have become a candidate tor for the office ot of district judge upon an independent ticket my first reason Is that I 1 have been asked to do so under the provisions ot of section 2183 ot of the revised statutes 0 of 1917 this statute was enacted in the wisdom ot of the legislators of lot utah so BO that it if a few so called politicians shall attempt to override and oppose the tree free expression of the will ot of the people by conducting either the primaries or the conventions in such a manner as to prevent that tree free expression the people may nevertheless sign a certificate ot of nomination signed by not less than one hundred resident voters ot of the district this will get before the people the man 0 of their choice one hundred fifty five resident voters ot of this district signed the certificate of my nomination and I 1 NO fed bound to submit to their wishes it was the saving torea of this thic statute which enabled the good pelide of salt lake county count to nominate and elect sheriff ben J harries the pre pra sent sheriff ot of salt lake county when the small group of politicians of the county convention refused to nominate him it was a case of the people speaking and exercising their own will and choice the people have been doubly paid tor for their effort mr air harries Is now under no political obligation to the members ot lot the convention and the people ot of salt lake county are enjoying a vigorous er enforcement of the laws I 1 claim that it if there had been a tree free expression of the will ot of the people I 1 should havo hato been nominated and so declared it was the lean ican and unfair methods adopted by a small clifue ot of delegates both at the convention and for weeks before the convention which prevented my being nominated I 1 was defeated by the broken pledges 0 of delegates from washington county and the broken instructions ot of delegates from iron county which prevented my nomination and in spite of these broken pledges and instructions I 1 was the first candidate forthe for tor the office ot of district judge to receive the necessary majority upon the second ballot the first ballot being a tie I 1 received 39 votes and mr burton 37 the ballots 1 had been cast in writing gathered counted and the result became known but I 1 was w cheated out of the nomination by taking a recess I 1 in n order to allow sufficient pressure to bo be brought upon a man who had bad pledged himself to vote for me tor for three months before the convention and the last minute before the convention went into cession I 1 know that I 1 was the choice of the people hoople ot of the district or at least the republicans of the district the main and cont controlling roling object ot of electrons elections Is to give the people an opportunity port unity to vote for the men me ot of their cholee choice this eal cai not be done doli unless there Is a treo free expression of the public will there can bo be no expression of public will when a few delegates dele gatea go to a convention with some special interests to in utter disregard of the public will citizen citizens us ot of the district nominated me ine to this office 76 people or a narrow r ow majority of 76 people nominated T H Burt burton my 1 opponent P P I 1 graduated from tho the law department ot of the university ot of utah fourteen teen years ago I 1 have been actively engaged in the practice over ever since aud and nearly one half of that time I 1 have been in the tha position of public prosecutor I 1 claim that my record is of a high and efficient character and that I 1 am entitled to the tha vote and confidence of the people I 1 claim that T 11 burton was vai appointed to succeed W F knox as presiding judge without the knowledge of the voting public in hta his appointment the people were not consulted they exercised no choice in the matter and I 1 claim that such methods are in utter disregard of public will and should bo be frowned upon and rebuked I 1 believe in a government of the people by the people and tor for the people this great and all import ant object can call not bo be accomplished unless and until the people have a fair and free opportunity to express their unfettered will it Is a matter of record that when T 11 burton yas county attorney of juab county he flatly refused to prosecute one george schly who mr burton stated in writing wits was guilty of a criminal assault upon a little girl not ten years of age and also stated in writing that there wits was sufficient evidence to convict of this assault it Is also a matter of r record ecord that T H burton refused to prosecute moses gudmundson and his associates tor for living in open adulterous relationship lation ship among their little children for which conduct thirteen of their company were excommunicated from the church the record will show that I 1 did prosecute them all and nd in some ot of the cases I 1 secured a conviction notwithstanding T H burton used his hi energies to prevent a conT conviction letlon I 1 did this at a heavy expense to myself for which the stats stat can not becom pon pc sate me I 1 refer to these matters because they came under the direct observation of the citizens of juab jenab county land and I 1 can not understand upon ubo a what wha t basis of reasoning they can support a man who has made the record mr burton has made in tho the handling of criminal cases cased I 1 can not understand what particular qualification lie he has td cause the delegation to seek hla his nomination to the point of absolutely disregarding what the voting public way may desire in the matter I 1 think it Is only fair to call the attention of the voters to ill bis 8 record because upon his hl record he ha must be willing to stand I 1 am willing and anxious to hive have the people investigate my record from beginning to end and if it has not been clean and efficient I 1 am willing to be voted against
