Show 3 TO THE constitution SENATE JOINT resolution NUMBER EIGHT proposing an all amendment to article 13 of 0 the constitution ot the state of utah relating to revenue arid and taxation be it resolved by tho the legislature of tho the state stata of utah two thirds of all members elected to each ot tho the two houses concurring therein section 1 it la Is proposed to amend ardele 13 ot of the constitution ot the state ot of utah so that the same will read as aa follows 11 1 tile tho power ot of taxation shall never be surrendered suspended or contracted away avay all taxes shall bo uniform upon the same class of property erty within the territorial limits of tho he authority levying tho the tax and shall be levied louled and collected tor for public purposes only 2 tho the legislature shall provida by law tor for an all annual tax sufficient with other sources of revenue to dotray the estimated ordinary expense ot tho the state tor for each fiscal year yar for the purpose ot of paying tho the state debt if any there be the legislature shall provide tor for levying a tax annually sufficient to pay the annual inte inter interests rest estl and principal of such debt within twenty years from the final passage ot the law creating tho the debt 3 there shall bo be exempt from taxation property of tile the united states ol of the state counties ciplys towns school districts municipal corporations and public libraries lots lota with the buildings thereon hereon used exclusively for either religious worship or char table purposes and places ot of burial not held or used tor for private or corporate beri benefit eft ditches canals reservoirs pipes and flumes blumes owned and used by individuals or corporations for or irrigating lands owned by such individuals or corporations or the individual members thereof shall not bo be sopar separately abely taxed so long as they shall be owned and used exclusively tor for such purpose provided that mortgages it upon poll real and personal pora onal property shall be exempt from taxation and that the taxes of 0 tile the indigent poor may be remitted or abated at such time and in such manner as may bo be provided by law 4 the legislature shall not impose taxes tor for the purpose of any ally county city town or other municipal corporation but may by law vest in the corporate authorities cherot respectively ively the power to assess and I 1 collect taxes for all purposes ol of such corporation 5 the surface ground of all mines and mining claims both placer and rock in place containing or bearing gold s v copper lead iron ciroli or other val valti ibl metals after purchase thereof from the united shall bo be taxed lit it a value not greater than the price paid tile the united states there for urile mile the surface ground or somo some pull par hereof of oc such mine or claim Is used for other than mining purposes pui poses and has a separate arid and independent value tor for such other purposes in which case casa said stir surface face ground or any part thereof so BO used tor for other than mining purposes shall be taxed macd at its value bior for such other I 1 purposes as provided by law and all machinery used lit in in mining ining and all property and surface improvements upon or appurtenant to mines and mining claims which havo have a value separate and independent of such minus mines or mining claims shall be taxed as provided by law all lands containing coal granite stone marble onyx gas oil hydrocarbons hydro carbons gypsum or othor other valuable mineral deposits other than those enumerated above lit in this section after purchase thereof from the united states and all property and surface improve menta upon or appurtenant to such lands landa which have a value separate and independent of all such lands shall be taxed as provided by law in addition to tile tho assessment of 60 the surface grounds improvements and machinery elli nery of mines and mining claims all mines and mining claims producing net proceeds shall be taxed at a va value I 1 ue no not t to exceed three times such buell net proceeds G an accurate statement ot of tile the receipts and expenditures expenditure of tile the public moneys shall be published annually in such auch manner as the legislature may provide 7 tile the rate of taxation on property tor for state purposes poses shall never exceed eight mills on each dollar ot of valuation to be apportioned as follows not to exceed tour four and one halt half mills on each dollar ot of valuation for or general state purposes not to exceed three mills oi each dollar ot of valuation tor for district school purposes not to exceed ono halt mill on each dollar ot of valuation for or high school purposes that part ot of the state tax apportioned to high school purposes shall constitute a fund to bo be called tile the high school fund and shall bo be apportioned to tho the cities and school districts maintaining high schools in tho the manner the legislature may provide anil and who whenever never tile tho taxable property within the state shall amount to four hundred million dollars the rate hall not exceed five mills on oil each cach dollar ot of valuation unless a proposition to increase such rate specifying sped tying the rate proposed and the time during which tile the same shall bo be levied bo be first submitted to a vote of such ot of the qualified fled electors ot of tile the state as in fit tile tho year next prece proceeding eding such election shall have paid a prop urty orty tax assessed to them within the state cud and the majority ot of khoste thoste voting thamon shall vote veto in favor thereof in such manner as may bo be provided by la law 5 tile tho making mailing of profit out of public moneys using tile the same tor for any purpose not authorized by law by any public officer shall be deemed ti a felony and shall be punished as provided by law but part of such punishment shall be disqualification to hold bold public office 9 no appropriation shall be made mada or any expenditure authorized authorised by the legislature whereby the expenditure of tho the state during any fiscal year shall hall exceed the total tax then provided d for or by law and applicable for or such appropriation or expenditure unless the legislature making such appropriation ria tion shall provide for or levying a sufficient tax not exceeding tho the rates allowed lv iv section 6 af d this article to pay such appropriation or expenditure within such fiscal year this provision shall not appl to appropriations riat ions or expenditures to suppress insurrections defend the state or assist lit in defending the united states in time 0 of war 10 nothing in this constitution shall bo be construed to prevent the legislature from providing a stamp tax or a tax based on oil income occupation licenses or franch franchises iBes sec 2 tho the secretary ot of state Is hereby ordered to give this pro proposition post to bo ba published lu lit at least one newspaper lit in every county lit in the state a newspaper la Is print printed a d and published for or two months preceding the next general election see sec 3 this proposition shall b submitted to the electors of this state at tile the next general election tor for their approval or disapproval all off official lelal ballots used at such election shall lave printed or written thereon the words for the tha amendment of 0 article 13 ot of the constitution rela to taxation yes yea no and shall olier wise be prepared and submitted to the electors as may bo be otherwise provided by law and said ballot shall be ba received counted and canvassed and returns thereon be made in ill tile the same manner and in fit all respects as lit
