| Show commissioner nixon offered the follow ing resolution and moved its adap tion I 1 WHEREAS AS ube the melville Mel villo irrigation C company a corporation organized under the laws of f utah was on and prior to the ath day ay of march 1907 and still is the owner of certain land situate within millard county utah and laid out and platted certain lands into lots streets alleys and public places designating c and naming said plat as a plat of the town of melville Melvi ile and madean made an accurate map or plat thereof particularly setting forth and describing all the parcels of ground as laid out and platted by their boundaries course and extent and whether intended for avenues streets lanes alleys etc or other public uses together with such as were reserved for public purposes and all lots intended for sale by numbers and their precise length and width and WHEREAS said company did on the ath day of march 1907 file with the county clerk of millard county a map and plat of said lands duly acknowledged led as required by law and certified I 1 by the surveyor making such plat and said plat was presented to this board on the ath day of march 1907 and duly approved by it and was thereafter acknowledged certified and approved and on the day of 1907 duly filed and recorded in the office of the county recorder of millard coun county i ty that being the county in which tile the lands platted and laid out as shown by said plat are situate said plat being 0 so filed purporting in in to be a plat of the town of melville and showing the lots blocks streets alleys and public pla places ces within said town and WHEREAS said melville irrigation company is still the owner of all said lands within said town of melville and as shown by and represented upon said plat and map and did on the fth day of juno june 1908 tile file with this board a petition p praying baying raying th that at this board male an order alternating chanin chan changing in and amend in ing said plat so file filed dand and recorded so that the same would be a plat of the town of burtner instead of the town of melville and RO fio that said lots blocks streets alleys and all the lands within said plat should be designated as bein being 1 within the town of burtu df ur j r instead of the town of alel melville for the reason that a post office has been esta established blushed bli shed on said lands and the postoffice Post Office had been established on said lauds lands and the post office ap named inda bu burtner artner and for the further reason talat said lands were known as the town of burtner instead of ache town of melville and all of the stockholders of said melville irrigation company desired said alter nation change and amend ment and further that neither the public nor any person would be injured by said change tn alteration and amendment and REAS upon the filing of said petition and application a hearing was had at the next reg ular meeting of this board there after being 0 the meeting of this date and WHEREAS upon said hearing it appears appeals to this Hoar Boar dand the in members e m bers there fc hereof of are satisfied that neither the public nor any person will be injured by the granting of said petition and ap and amending altering and changing said plat as in said petition prayed for and abshere as hereinbefore in before set forth NOW THEREFORE ORE it is hereby ORDERED that said plat so filed and recorded in the office of the county recorder on the day of march 1907 as and for the plat of the now town of melville be and the same is hereby altered changed 0 and amended so that the same will be a plat of the town of burtner and the word melville best be stricken riken and the word I burtner insert e ed d in lieu thereof and it is fur t her ORDERED D that the lands d designated as lots and blocks w athin the town of burtner and it is f fu u ther ither hereby ORDERED that this order shall be recorded in the office of the recorder of millard millard county state of utah adopted this ath day of june A D 1908 hyrum S cahoon chairman 0 W hopkins george rd W nixon county commissioners ATTEST nephi A anderson clerk S SEAL E A L |
