Show CONSTITUTIONAL AMENDMENT NO. 2 Proposing to Amend Elections 2 and 3, Article XIII, of the Constitution Constitu-tion of Utah Relating to Property Subject to Taxation and Rate of Tax A resolution proposing amendment to Sections 2 and 8, Article 13, of the Constitution of the State of Utah relating re-lating to property subject to taxation and rates of tax. Be it resolved by the Legislature of the State of Utah, two-thirds of all the members elected to each house concurring therein:. Section 1. That it is proposed to amend Sections 2 and 8, of Article 13 of the Constitution of the State of Utah, so that such sections will read as follows : Sec. 2- To the end that the burden of taxation may be equitable upon all property, the legislature is empowered to divide all property including moneys mon-eys and credits as well as physic-property, physic-property, into classes and to determine deter-mine what class or classes of property proper-ty shadl b sol)1ect to taxation and what property, if any, shall not be suhjei't to taxation. Taxes shall be uniform upon all property of the same class and shall be levied and collected collect-ed for public purposes only. Taxes may te Imposed upon any and all property, including privileges, franchises fran-chises and licenses to do business in the state, but this shall not be so construed con-strued as to authorize th taxation of the stocks of any company or corporation corpora-tion when the property of snch company com-pany or corporation represented by such stocks has been taxed. The legislature leg-islature is empowered to impose taxes tax-es upon incomes, which taxes may be graduated and progressive and reasonable reason-able exemptions may be provided, and a credit may be allowed on in come taxes tax-es for property taxes paid within the year; provided, that nothing in thia section shall permit classification of mines or mining claims. Sec. 8. The property of the United Unit-ed States, of the state, counties, cities, towns, school district, municipal corporations cor-porations and public Ubraries, lota with the buildings thereon need exclusively ex-clusively for higher religions worship or charitable purposes and places of " burial not held or used for private or corporate benefit, and mortgages upon both real and personal property shall be exempt from taxation. Ditches, canals, reservoirs, plpea, and flumes owned and ;;bm1 by individuals or corporations cor-porations for irrigating lands a nan by such individuals or corporations, or the individual members thereof, shall not be separately taxed so long as they shall ba owned and ased exclusively ex-clusively for such purpose; a deduction deduc-tion of debits from credits may bo authorized and taxes of the indigent poor may be remitted or abatod at such time and in such manner a y be provided by law. Sec. 2. The secretary of state is directed to cause this proposed amendment amend-ment to be published as required by the constitution and to bo submitted to the electors of the state at the Bait general election la the manner provided pro-vided by law. .
