Show J ORDINANCE NO. 43. j AN ORDINANCE prohibiting ' minors on streets, vacant lots and public places at certain hours, and ; prescribing penalties for the viola- 'tion of the provisions thereof; and repealing Chapter XIV of the Re- . vised Ordinances of Milford, 1924, and all other ordinances and parts of ordinances in conflict herewith. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF MILFORD, UTAH: Sec. 1. CHILDREN SHALL i NOT BE ON THE STREETS. I ETC. WHEN. It shall be unlaw- ifu for any person under the age i of sixteen years to be or remain in or upon any of the streets, alleys, vacant lots or public places (in the Town of Milford at night after the hour of nine o'clock, excepting ex-cepting during the months of May, 'June, July, August and September in each year, when such time shall he extended to ten o'clock, unless I said person is accompanied by a parent, guardian of other person 1 having the legial custody of such J minor person, or is in perf ormance :of an errand or duty directed by such parent, guardian or other person having the care and cus tody ol such minor person, or I whose employment makes it necessary to be upon said streets, alleys, or .public places during the night time after said specified hours. Any person violating the provisions of this section shall, on I conviction, be fined in any sum not to exceed five dollars for each i offense. I Sec. 2. PARENTS, GUARD-:LANS, GUARD-:LANS, ETC. NOT TO PERMIT. It shall be unlawful for any parent, par-ent, guardian, or other person having the legal care and custody ! of any person under sixteen years I of age, to allow or permit any i such child, ward or other person under such age, while in such : legal custody, to go or be in or upon any of the streets, alleys, j vacant lots or public places in this j town within the time prohibited in Section 1 of this ordinance, unless : there exists a reasonable necessity therefor. Any person violating ! the provisions of this section shall, i upon conviction, be fined in any I sum not to exceed ten dollars for I each offense. j Sec. 3. PEACE OFFICERS TO i ARREST. The town marshal or : any police officer of this town is i hereby authorized to take into i custody, without warrant, any per- son wilfully violating the provis- ions of Section 1 of this ordinance, and retain such person a reasonable reason-able time ' upon Svhich complaint can be made and a warrant issued and served; provided, whenever any officer takes a child into custody, he shall, unless it is im- practicable or has been otherwise ordered by the court, accept the written promise of the parent. guardian or custodian to bring the t child to the court at the time fixed. Whereupon such child may be released to the custody of the parent, guardian or custodian. If : not so released, such child shall be detained in custody as provided : by law in such cases. Sec. 4. DUTY OF THE JUSTICE JUS-TICE OF THE PEACE. It shall be the duty of the Justice of the Peace of this town, upon the arrest ar-rest of any minor person or child, where the parent or guardian has refused to become responsible for said minor child for violation of 1 the provisions of Sections 1 and 2 of this ordinance, to inquire i into the facts of said arrest and 1 the condition and circumstances i of such child or minor person as j to want of proper parental care. and if it appears that such child j or minor person is growing up in mendicancy or vagrancy, or is in-' in-' corrigible, to cause the proper i proceedings to be had and taken as 1 authorized and provided by law in 1 such cases. I Sec. 5- CURFEW SIGNAL. It ! shall be the duty of the president I of the board of trustees of this town to arrange for some proper curfew signal. Sec. 6. PROVISIONS OF THIS ORDINANCE NOT TO APPLY. WHEN. The Board of Trustees I of this town may, in its discretion and upon resolution duly adopted ! exempt from the provisions of ' this ordinance both children and adults when the children, on the nights provided in such resolution, are jroing to and from some f unc-1 tion being sponsored and carried , on by school or church authorities or by some recognized organiza-; tion engaged in providing enter-; tuirinient for such minors. Sec. 7. REPEAL. That Chapter! N1V of the Revised Ordinances of j MilforcL iy24, and all other ordinances ordi-nances and parts of ordinances in conflict herewith, are hereby repealed. re-pealed. Sec. 8. DATE OF EFFECT. This ordinance shall take effect and be in force upon the fifth day after publication thereof.
