Constitutional Amendment No. 2 ' A Joint Resolution Proposing an Amend-' ment to Section 10, of Article VII, of the Constitution Relating to Governor's Appointive Ap-pointive Power and the Filling- of Vacancies Va-cancies in Certain Offices. (Superintendent (Superin-tendent .of Public Instruction.) Be it resolved by the Legislature of the State of Utah, two-thirds of ail the members elected to each house concurring concur-ring therein : SECTION 1. That It Is proposed to mend Section 10, of Article VII, of the . Constitution of the State at Utah, as follows fol-lows SECTION 10. The Governor shall nominate, nom-inate, and by and with the consent of the Senate, appoint all State and district officers offi-cers whose offices are established by this . Constitution, or which may be created by law, and whose appointment or tlection is not otherwise provided for. If, durinar the; recess of the Senate, a vacancy occur in any State or district office, the Governor hall appoint some fit person to discharge the duties thereof until the next meeting of the Senate, when he shall nominate some person to fill such office. If the office of justice of the supreme or district court. Secretary of State, State Auditor, State Treasurer, or Attorney-General be vacated by death, resignation or otherwise, it shall be the duty of the Governor to fill the same by appointment, and the appointee shall hold his office until his successor shall bo ejected and qualified, as may be by law provided. SECTION 2. The Secretary of State is hereby directed to submit thia proposed amendment to the electora of the state at the next general election In the manner provided by law. SECTION 3. The general control and upervision of the Public School System hall be vested In a State Board of Education, Educa-tion, consisting of such persons aa the Legislature may provide. SECTION 2. Secti.-n 2 of the Constitution Constitu-tion of the .-tate of I'tah. as Amended at the General Election in 130 Relating to Taxation of Tancible Property, Ascertainment Ascer-tainment of Value, .Evemptions, and thl Annual Tax for the State. Be it resolved by the Legislature ot thl State of Utah, two-thirds of all numberi elected to -ach House and two-thirds ol all members of arh House concurring therein : SECTION I. That it is proposed to amend Article XIII. Section 2 of the Constitution Con-stitution of the State of Utah, as amended at the general election in 1930, to read as follows : SECTION 2. All tangible property in the State, not exempt under the laws of the United States, or under this constitution, shall be taxed in proportion to its value, to be ascertained as provided bv law. Tha property of the United StaUs. of the State, counties, cities, towns, school districts, municipal mu-nicipal corporations a.id public libraries, j lots with the buildings thereon used exclu-I exclu-I sively for either religious worship or char-i char-i ilable purposes, and places of burial not held or used for private or corporate benefit, bene-fit, shall be exempt from taxation. Water rights, ditches, canals, reservoirs, power plants, pumping plants, transmission lines, pipes and flumes owned and ustd by individuals indi-viduals or corporations for irrigating lands within the state owned by such individuals or corporations, or the individual members thereof, shall not he separately taxed as Ionic as they shall bo owned and used exclusively ex-clusively for such purposes. Power plants, power transmission lines and other property proper-ty used foi generating and delivering electrical elec-trical power, a portion of which is used for furnishing power for pumping water for irrigation purposes on lands In tha State of Utah, may be exempted from taxation taxa-tion to the extent that such property is used for such purposes. These exemptions shall accrue to the benefit of the users of water so pumped under such ' regulations as the legislature may prescribe. The Uixes of the indigent poor may be remitted- or abated at such times and tn such mnner as may be provided by law. The !vgis!atura may provide for the exemption from taxation taxa-tion of homes, homesteads, and personal property, not to exceed $2, 000 in value for homes and homesteads, and $300 for personal per-sonal property. Property not to exceed $3,000 in value, owned by disablr persons who served in any war in the military service serv-ice of the United States or of the State of Utah nnd by the unmarried widows and minor orphans of such persons may be exempted ex-empted as the legislature may provide. The legislature shall provide by law for an annual tax sufficient, witJi other sources of revenue, to defray the estimated ordinary ordin-ary expenses ot the state for each fhral year. Constitutional Amendment No. 6 A Joint Resolution Proposing to Amend Section 9, Artie: VI of the Constitution of Utah, Relating to Compensation of Members of the Legislature. Be it resolved by the Legislature of the State of Utah, two-thirds of all the members mem-bers elected to each of the two houses voting in favor thereof: SECiTON 1. That it fs proposed to amend Section y. Article VI, of the Constitution Con-stitution of the State of Utah, as follows: SECTION I. The members of the Legislature Legis-lature ahall receive such per diem and mileage mile-age as the Legislature may provide, not exceeding ex-ceeding eight dollars per day .nd ten cents per mile for the distance necessarily traveled trav-eled going to and returning from the place of meeting on the most usual route, and they shall receive no other pay ot perquisite. per-quisite. SECTION f. The Secretary of State is hereby directed to submit this proposed amendment to the electors of the stute at the next general election in the manner provided by law. SECTION 3. If adopted by the electors of the state, this amendment shall take effect ef-fect the first day of January, 1937. I, M. H.
