Stohl to recover a profit alleged to havo been made by tho defendants whllo thoy wero acting as ngents or tho company bofoio Its Incorporation. The contract for tho purchaso of tho Knight sugar plant at Raymond Canada, was admitted nt tho meeting meet-ing to havo been nrndo for the plalnl tirt company by Hendrlckscn, according accord-ing to tho testimony ot William J. Funk, a stockholder of tho company. Tho" contract was entered as nn exhibit in the ense. It is said to show that the Knight sugar plant, purchased purchas-ed In Raymond nnd transferred to Cornish, Utah, was sold to Hendrlck-son Hendrlck-son for $175,000. TELLS OF COMPANY'S MEETING Mr. Funk testified that after tho reading of tho auditor's report at tho meelng Mr. HendrlckBon arose and said ho objeced to tho adoption ot tho report because It was false and that ho could provo It to bo by a document. This document wns takon out of a basket .continued Funk, and when Heudrlckson announced that he would lead It, he was anked by Mr. Woolley what it was ho Intended to read. The answer came that It was the original contract mado with tho Knight Sugar company. "Is that tho contract between tho West Cache Sugar Company and the Knight Sugar Company?"
