Show AN ORDINANCE An Ordinance Relating to tho Man ufacturo, sale, giving away or otherwise oth-erwise disposing of, intoxicating llq uors within tho Corporato Limits of Logan City, and providing a penalty therefor, and ro enacting Sections 429, 430, 431, 432, 433, 434, 435, 43G, 437, 438, 440 and 441, and amending Soetlons 439 and 442 of tho Revised Ordinances of Logan City, 1912. IJo It Ordained by tho Hoard of City Commissioners of Logan City, Utah, as follows: 429. Salo of Prohibited. That no ono within the limits of Logan City, by himself, his dork, servant, employee, em-ployee, or agent, shall for himself, or any person else, directly or lndl rcctly, or upon any pretense or any dovlco, excopt as provided in this ordlnanco manufacture, sell, exchange barter, dispense, servo, give in consideration con-sideration of tho purchase of any property or of any services, or 1" evasion of this ordinance, or keep for salo, any Intoxicating liquor, or Bollclt, tnko, or accept un order for tho purthaso, salo, shipment, servlco or delivery of any such liquor, or aid in tho dollvory and distribution of any intoxicating liquor so ordered or shipped, or own, keep, or bo in any way concerned, engaged or employed em-ployed In owning, or keeping for salo any Intoxicating liquor witli intent to vlolato any provision of this ordinance, ordin-ance, or nuthorlzo or permit tho samo to bo dono. 430. Soliciting Sale Prohibited. It shall bo unlawful for any person to solicit within tho corporate limits lim-its of Logan City, tho sale of any intoxicating in-toxicating liquors, elthor in person or by sign, circular, lottcr, card, prlco list, advertisement, or otherwise . Tho provisions of this section shall not apply to a porson soliciting orders from a licensed druggist. 431. Permit to Soil on Premises. It shall bo unlawful for any ownor, lossor, Icsseo or other person In possession pos-session of any building, room, booth, enclosure or othor plato within Lo-gan Lo-gan City, to permit any porson to sell, keop for salo, glvo away or otherwise oth-erwise dlsposo of any Intoxicating liquors in or on. any such premises, except as provided In this ordlnanco. 432. Salo Upon Prescription. Any registered pharmacist may sell and furnish Intoxicating liquors for medical medi-cal purposes only, upon tho written prescription of a regularly practicing physician of tho State of Utah, In tho mnnnor horeln provided. Th'o proscription pro-scription bhall contnln tho name of tho person proscribed for, tho quantity quan-tity and kind of liquor prescribed, and Bhall bo signed by tho prescribe Ing physician. No prescription shall bo lilted hereunder except upon tho day upon which it is dated and Issued or upon tho following day. On tho first day of Juno nnd January of each year tho registered pharmacist shall lllo all such proscriptions filled within with-in tho preceding six months, with tho city recorder of Logan City. Such proscriptions shall, nt any tlmo after having beon filled, bo open to public Inspection. A foo of $1.00 for each lot of proscriptions so filed shall bo paid by tho Bald druggist to tho city recordor. Provldod, however, that it such prescriptions aro filed and said fco Is paid In conformity with tho law of tho Stato of Utah, this ordlnanco ordln-anco shall not bo construed to ro-qulro ro-qulro tho filing of additional proscriptions proscrip-tions or tho payment of any additional addition-al fee. No prescription shall bo ro-filled ro-filled nor Bhall moro than ono quart bo furnished on ono proscription. Nothing No-thing In this ordlnanco shall bo construed con-strued to provont druggists or rogls-torod rogls-torod pharmacists from furnishing or selling intoxicating liquors In wholo-salo wholo-salo quantities to registered pharmacists, pharm-acists, to public or charity hospitals, to medical or pharmaceutical colleges or to scientific schools or institutions. All druggists and registered pharmacists pharmac-ists shall keop a comploto record of all sales at wholosalo of Intoxicating liquor, which rocord shall ot all times bo open to Inspection of tho pt-aco ofllcors of this city. No physician Bhall Issuo a proscription except for bonn fldo medical purposes. 433. Obtaining Upon Prescription Illegally. It shall bo unlawful for nny porson to obtain from a physician n prescription for intoxicating liquors liq-uors with intent to procuro Intoxicating Intoxi-cating liquors to bo used as a bovor ago and to produce Intoxication and tho fact that tho person obtaining such prescription becanio intoxicated on tho liquors purchased on such pro scrlptlon shall bo prima faclo ovl-donco ovl-donco that such prescription was obtained with such Intent. 434. Idem. It shall ho unlawful for any physician to Issuo a prcscrlp tlon for Intoxicating liquors, with Intent In-tent to aid any porson to procure Intoxicating In-toxicating liquors to bo used ns n bovcrago. 435. Aiding Porson Unlawfully Obtaining. Ob-taining. It shall bo unlawful for any poison with Intent to aid any porson to obtnln intoxlcntlng liquors, to leavo or placo tho samo where J thoy can bo obtained by any person or taken away, and tho owner, les-sco, les-sco, or person In possession of the premises whero intoxicating liquors aro so left or placed, shall bo deemed guilty of a misdemeanor. 43G. Illegal Sales by Druggl.it. No druggist or other person within Logan Lo-gan City shall sell, dispose of, or glvo away any proprietary, patented, or compound medicines, classed by tho United States Commissions- m Internal Rovenuo as an intoxicating liquor insufriclontfy medicated to ronder them unsuitable as beverages, oxcopt upon tho prescription of a licensed li-censed and practicing physician of the Stato ot Utah. 437. Sales for Scientific Purposes, Emergencies. Nothing in this ordinance ordi-nance shall prohibit tho salo by II-censed II-censed pharmacists or wholesale druggists within Logan City of alcohol alco-hol for art, selenco, or mechanical purposos or wines to church officials for sacramental purposes. A record of such sales for said purposes shall bo mado and preserved In a book for that purposo, signed by tho person receiving re-ceiving tho samo, which record shall bo open to public inspection. Provided, that tho provisions of this ordlnanco shall not bo construed to apply to nny gift by any porson in caso of any Injury to anyono, or in caso of emergency for medical purposes, nor tho uso ot such liquors In the homes of individuals for family fam-ily or private uso. 438. Illegal Salo by Druggists. No druggist or licensed pharmacist shall, within Logan City, soil, exchange, barter, glvo away, or otherwise furnish fur-nish any intoxicating liquors, except as herelnboforo stated. 439. That Section 439 of tho Revised Re-vised Ordinances ot Logau City, 1912, is hereby amended to read as follows: fol-lows: Nulsancos. What aro. All places In Logan City whero intoxicating intoxi-cating liquors aro manufactured, sold bartered, given away, or otherwlso furnished in violation of this ordln anco, or whero persona nro pormttted to resort for tho purposo of drinking intoxicating liquors as a bovcrago, sold In violation ot this ordinance, or whero intoxicating liquors are kopt for salo, given away, or otherwlso other-wlso furnished In violation of this ordinance, and all Intoxicating liquors, liq-uors, bottles, glasses, kegs, pumps, bars, and other property kept In and used In maintaining such places, aro hereby declared to bo nuisances and every person who maintains or assists as-sists in maintaining such a nuisanco shall bo guilty of a misdemeanor. 440. Words. Doflued. Tho term "person" as used in this ordlnanco shall Include association, copartnership, copartner-ship, club and corporation and t ho singular shall Include the plural and the plural the singular; and tho masculine mas-culine shall Include tho fomlnlno. 441. Id. Tho term "Intoxicating liquors" as used In this ordlnanco, shall bo construed to moan any splr-Rous, splr-Rous, vinous, malt and fermented liquors liq-uors that may be used nB a bovorago and produce Intoxication, and all preparations and compounds thereof that may bo used as bpvorages nnd produce Intoxication. 442. That Section 442 of tho Ro vised Ordinances of Logan City, 1912 is hereby amended to read as follows: fol-lows: Penalty. Any person who shall In any way vlolato any of tho provisions of this ordlnanco shall bo guilty of a misdemeanor, and, excopt ex-copt as otherwise provided heroin, shall bo punished by a fino ot not loss than $50 nor moro than $299 or by Imprisonment In tho city Jail for not less than 30 days nor moro than G months, or by both such fino and Imprisonment..
