Bailey, who killed his brother-in-law, Eugene Smith, in Denver, Den-ver, has been granted a supersedeas by the supreme court of Colorado, pending a hearing on the merits of the case. The case has somo peculiar features, chief of which Is the fact that Bailey, at his first trial was con vlctcd of voluntary manslaughter which carries n maximum sentence of 8 years in prison. He demanded and secured a new trial and was convicted con-victed of murder In the first degree nnd sentenced to life. The question as to whether a husband has the right to use force In compelling his wife to leave her mother's home also It, brought up In this case. |
