Show Judge Howell Is Reversed Smith Case One In Question Sherlir Thomas II Smith will have to stand trial again on the charges brought against him by Albert A. Law, county attorney, and on which lie was cleared by a Jury before Judge John A. Howell late In 1007, following Instructions from the court. Tills was the decision of the supreme court In an opinion handed down Monday, written writ-ten py Justice J. E. Frlck and concurred con-curred In by Chief Justice W. M. Mc-Carty Mc-Carty and Justice D. N. Straup. In this opinion the supremo court overrules Its former .ruling In the famous fa-mous Touse case in the method of legal procedure. It Is now considered proper, through the decision Monday, Mon-day, to appeal to the supremo court without the appellant having filed a motion for a new trial with the trial court. This was denied in an opinion of the supreme court In the case of Mohr Touse against the Consolidated Railway and Power company, Issued several years ago. The suit to oust Sheriff Smith from office last year was one which stirred the county and was watched with keen interest throughout the northern part of the state.
