Show ABSENCE ALLOWED FROM homesteads united Sl alte te department ot of the interior general land office march 26 1932 the act of 0 march 2 1932 public no 61 51 entitled an act to excuse certain persons persona from residence upon hum homestead estead lands during 1920 1929 1930 0 1931 and 1932 in the drought areaba reads as follows that any homestead settlor settler or tryman in who during tile tha calendar year 1929 1930 or 1931 found it necessary or during 1932 should find it necessary to leave his homestead to seek employment in order to obtain tood food and a nd other necessaries ot of life tor for himself family or work stock because ot of serious drought conditions causing total or partial failure ot of crops may upon filing with the legister ot of the district proof ot of such conditions in the form of a corroborated affidavit fi be excused from residence up on OIL his homestead during all or part of the calendar yeas 1929 1930 1931 and 1932 and said entries shall not be open to contest or protest because ot of such absences PROVIDED that the time of such actual absence shall sha 11 not net be deducted from aiom the actual residence required by law but an all equivalent period shall he be added to the statutory life of the entry leaves of absences for all or part of the years mentioned by this act may be granted by tile the register of tile the district land office to any homestead settler or ft v lie ho has established actea I residence 11 upon pon the lands and who thereafter found it necessary to leave ills his homestead to seek employment in order to 0 food and other necessaries of life tor for himself family or work stock because of total or partial failure of crops due to serious drought I 1 conditions the application for such leave of 0 absence must be sworn to by the applicant and corroborated by a at t least one witness in the land dis district brict or county within which tle the lands clala ed under the homestead laws aro are located before any officer authorized to administer oaths and using a seal it must describe the land claimed and nd enow the date when residence was ea established thereon and how the tha same was maintained thereafter by giving tile the dates of b beginning eg inning and ending 0 f a all I 1 I 1 re residence st benco peri periods aad of all the character of tho the improvements and cultivation performed by the applicant c a nt it t must set forth fully all the facts on which the claiman nt lit bases ills his right to a leave ot of absence the purpose of ills his request for leave what effort was made to raise crops giving the dates of the planting and the kinds of crops planted and whether or not the drought conditions caused total or partial failure of crops if a leave of absence under tinder this act Is granted it protects the entry from contest or protest on oil a charge of abandonment unless it be shown that tile the leave of absence was wa s fraudulently obtained the failure of un jn to apply for such leave of absence does not forfeit hla his right to show in defense of a contest or protest the existence of 0 f conditions which might have been made the basis for such an application tile the period during h a homesteader is is absent from his claim pursuant to a leave duty duly granted under this act cannot be counted as any part of the actual residence on the land required by law but an equivalent period may be added to the statutory life of the entry |
