Show h THE SECTION CONT CONTEST EST the th egila asat to contest the he validity sf of the late election has been brought and the ike result is just what we thought it would be the sup supreme reme court handed banded d down 0 wn its decision in the case of M L Bit chie vs VB the state board of canvassers last monday at p in mr ritchie in his petition 1 asked that the above named board be restrained from canvassing the election returns and declaring the result of course the p petition edition brought into question the validity edity of the election law passed by the last legislature arid and as a natural result the election held on the 3rd ard of november last As was expected the court was of the unanimous opinion that the election law was valid in every respect and none of the points relied upon by the plaintiff we well taken the officers elect have nothing to do now but qualify and on jan 1897 at 12 noon hie the themselves to their several places of af official abode and take possession no doubt they will feel a little timid in taking such a step but we entertain the idea that there will be none of them who will not say that they are thankful for the privilege ta and that the duty is after all a pleasant plea one whether the va caters as they step down and out will say we do S so 0 with a certain degree decree of timidity in our oar breasts but irith an alacrity in our hearts query all those who would have resigned had the decision gone in their favor will no doubt be thankful that they are now relieved from such an arduous task the broad ax is truly grateful for such a tact fact and feels to congratulate the intended re signers in their narrow escape from such a dire calamity as work why the thought of such a thing as work especially in mid winter would cause a semi demi quiver to run up and down the vertebral columns of the soon to be ex officials the hearing of the case in the supreme court was one of great interest and occupied two long days there was a great array army of legal talent upon both sides and the court room was filled with eager listeners judge W H dixon the hon J IA L rawlins the hon EL B shephard judge judd jadd and judge henderson made arguments and submitted briefs for the sustaining of the election the work ot of these gentlemen in the preparation of their briefs showed the most diligent and careful research and their arguments before the court were delivered with such auch confidence and were replete with such reasoning from an earnest as can only spring conviction in the right aud and from a careful and conservative study of I 1 the underlying p principles these men deserve dearve and they may mav rest rast assured that they have the heart beaff felt thanks of almost the en tire tiTe people the she court listened to the arguments with rith an earnestness ana and patience W well ell worthy of the highest commendation and has rendered such cc si a decision ju in the daw caw aa aalthe the thought thon gha hot dem believes is des deserving ervin alte praise |
