AN ORDINANCE. AN ORDINANCE RATIFYING AND confirming trio transfor of tho franchise fran-chise granted to Harvey M. Bacon, which bocamo offoctivo March 2, 1893, extending the life- of. said franchise and amending tho same. Bo it ordained by. tho city council of Salt Lako City, Utah: 1 Section 1. That tho franchiso here, toforo granted to Harvey M. Bacon and his successors and assigns, to lay water wa-ter pipes ln certain streets of Salt Lake City, which became offoctivo Marrh 2 1893, and which by assignment has become be-come tho property of tho Hot Springs Sanitarium company, is horeby declared de-clared and ordained to bo vested in said Hot Springs Sanitarium company Sec. 2. Tho life, validity and terms' of said franchiso are horeby extended and ordained to bo fifty (60) years from tho time when this amendment becomes effective, and Section 4 of saia franchiso is to bo construed accordingly. accord-ingly. Sec. 3. That Section 1 of said franchise fran-chise bo amended so as to read as fol-lows: fol-lows: Section 1. That there is hereby granted to tho Salt Lako Hot Springs Sanitarium company, tho successor and assign of Harvoy M. Bacon, and to Its successors and assigns, for tho purposo of erecting and maintaining a bathing resort, or sanitarium, or both, in said city, where tho hot mineral waters of tho springs in or near tho north part of tho city may bo used, tho right to lay and maintain water pipo or pipes, as tho city enginoor may approve, to conduct such waters along tho following follow-ing mentioned avenues, streets, roads and alloys in said city, to-wlt: Tho alleys In tho Warm Springs Subdivision, Subdivi-sion, Cement avenuo, Limo avenue Agate street, Topaz street. Gem street! County or Stato road to Eighth North streot; thenco along tho County or Stato road;' Second West; Seventh North, and Wall to First West, or over such portions thereof, to and along First West street, and on Third South street from First West street into tho property formerly known as tho "Pal-aco "Pal-aco Stables," on Third South street, and now known as tho Sanitarium Bath House. Such pipo or pipes to bo laid at such placo or places and at such depths ln said streets or avenues, roads, lanes, and alleys, and to bo of such material and of such sizo as tho city onglneor may indicate, and under tho supervision of tho supervisor of strcots; and tho work of laying said pipe shall bo completed and In use on or before tho first day of July, 1907. Sec. 4. This franchiso extending tho franchiso granted to said Harvey M. Bacon is granted at tho request of said Hot Springs Sanitarium company, to enable It to roplaco tho pipe- now in use with other pipe; and tho same Is granted upon tho oxprcss condition that tho work of laying said pipo snun bo completed and ln use within twelvo months from the dato of tho passage of this ordinance, and that tho bond mentioned In Section 8 of said franchiso fran-chiso to said Bacon shall .apply to tho performance of tho conditions of this ordinance binding on said Hot Springs Sanitarium company, and that said Hot Springs Sanitarium company shall within thirty days after tho passapv- of tills ordlnanco procure tho assent of tho sureties on said bond that tho same shall bo appllcablo to tho provisions of this ordinnnco, and security for Its faithful performance of tho conditions 'of this ordinance, or they shall, within tho samo length of time, glvo to Salt Lako City a good and sufficient bond, to bo npprbved by tho mayor, in tho ponal sum of twonty-flvo thousand ($25,000.00) dollars, that said company will perform tho conditions mentioned in thl finance. Thit tvrant and all tho terms and conditions thereof shall bo accoptod in writing by tho grantoo within thirty days from tho approval of this ordinance, ordi-nance, othorwiso tho samo shall bo void and of no effect. Sec. 5. All ordinances and parts of ordinances in conflict herewith aro horeby repealed to tho extent of such conflict. Sec. 6. This ordinance shall take effect ef-fect upon approval.
