CREATING A RESERVE FUND AND LEVYING A TAX ALL AS PROVIDED IN CHAPTER 31 OF TfiXB 17 (SUPP.) UTAH CODE ANNOTATED, 1953, AS AMENDED BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF GARFIELD COUNTY, STjATE OF UTAH: Section 1: In the opinion of the Board of Commissioners of Garfield County it is and will be In the best interests and will promote the general welfare of Garfield County, its citizens, and inhabitants If there Is established and created within and for Garfield County a recreational, tourist, and convention promotion bureau as provided In Section 17-SM Utah Code Annotated. 1953. Section 2: There is hereby created and established a recreational, tourist, and convention bureau which, until otherwise provided by resolution of the Board of County Commissioners shell consist of three (3) members who shall be the three members of the Board of Commissioners of Garfield County until their successors are appointed and shall qualify as hereinafter set out. Section 3: The recreational, tourist and convention bureau shall have all of the authority, powers, and responsibilities set forth in Section 17-31-1 through 17-31-7. Utah Code Annotated, 1953 but there is reserved to the Board of County Commissioners all of the authority which the Board of Commissioners is authorized and empowered to exercise under those rections. The Board of County Commissioners may create executive committees, bureaus, or subsidiary organizations and may call such auxiliary, executive, or subsidiary organization the Garfield County Recreational, Tourist, and Convention Bureau; provided that none of the statutory authority granted to the Board of County Commissioners shall be delegated to the promotion bureau but only those powers which are by law susceptible to and capable of a delegation to the members of the bureau; and provided further that on any such executive, auxiliary, or subsidiary committee no less than one (1) member of the Board of County Commissioners shall be an ex-offlcio member. Section 4: There is hereby levied and imposed, as provided in Section 17-31-2, Utah Code Annotated. 1953, a trans-lent room tax in the amount of one and one-half (lH) percent of the rent for every occupacy of a suite, room or rooms on all persons, companies, corporations, and groups or organizations doing busi- ness as motor courts, motels, hotels, inn, or like and similar public accommodations in Gar-licld County, State oi Utah. .said tax and the proceeds thereof shttU be devoted and dedicated exclusively for the purpose of establishing, financing, and promoting recreational, tourist, and convention bureau aliairs and shall be paid into a reserve fund to be used solely for those purposes and any lunds collected but not expended during any fiscal year shall not revert to the General Fund but shall be retained in the special fund to be used in accordance with this ordinance. Section 5: For purpose of this ordinance the term "transient" is defined as any person who occupies any suite, room, or rooms in a motel, hotel, motor court, inn, or similar public accommodation for fewer than thirty (30) consecutive days. Section 6: Hie tax for which provision is herein made shall be levied a' the same time and place and in the same manner as is provided in Title 11, Chapter 9, Utah Code Annotated 1953. "The Uniform Local Sales and Use Tax Law of Utah." Section 7: This ordinance shall take effect immediately upon its passage and the expiration of fifteen (15) days after its first publication or on or before the 3 day of January. 1969, whichever date shall last occur. Section 8: IT IS FURTHER ORDAINED that the Clerk of Garfield County is directed to cause this ordinance to be published in the Garfield County News, a newspaper of general circulation in the county immediately and with the next publication thereof.
