Show Hatch Dam Issue Decided In Locals Favor By High Court In a history making and precedent setting decision written by Justice Lester A. Wade, the Utah State Supreme court decided the hot "Hatch Dam" Issue In favor of the local Upper Se-vler River Water Users. They can now go ahead with the building of the proposed dam. f However, the court declared downstream users below the Kingston measuring station must continue to receive the same amount of water as In the past. Only one major point In the decision of Judge Lewis Jones, of the first district, handed down after Pangultch hearings, was reversed; The state engineer and the water commissioners, are. to do the measuring and enforcing, rather than letting the Upper River users do It. The opinion was unanimous with Justice George Worthen not participating and Justice F. Henri Henrold concurring In part. "Clarence Foy, president of the Upper Sevier Water Users , Association, expressed himself as delighted with the decision ; which ended an Involved and expensive court fight extending over, years. The board of directors of the Water Users Association will meet In the early part of June, together with attorney Wllford M., nurton, of Salt Lake City, to decide further steps. Board members are Jack Yar-dley, Pangultch; Jim Burrows, , Hatch; Carl LeFevre. Spry; Douglas -Cannon, Rex Whlttak-er and Scott Smith, Clrcleville; , Clarence Foy, president;' Pan-T -"""""? gultch. It Is likely that at that time the SCS or some oher body of experts will be called In to de. sign the dam, and money raising projects will be discussed -at that time. |
