and box elder county were heard before judge melvln melvin C harris in the district court in this city wednesday morning at 10 the cases case s were box elder county vs the chesapeake Ches duck club and box elder county vs the silt land company county attorney J wesley horsley appeared tor for the county attorney wm J lowe represented the game associations ciati ons attorney leroy B young the land companies and J walcott thompson tor for the duck club at the hearing were david H madsen state game warden J T state land commissioner deputy ellason ot of the land department and engineer patterson Patter soa or of the state road commission and a number ot of local citizens both complaints were filed at the ahe instance ot of the state land boards board and the state fish and game department supported by the box elder fish and game protective association and a number ot of local sportsmen the complaints alleges that the last legislature authorized the fish and game department to declare certain lands as public hunting grounds the state ot of utah through the state land board leased to the state fish and game department 2786 acres lying west ol of brigham city and on bear river bay and after the lease the state fish and game department published proclamation declaring this land as a public hunting ground As a result the state supported by br the box elder fish and game protective association appeared before the board of ot county commissioners here who authorized condemnation proceedings to be filed the district court gran teda temporary order permitting the use ot of a three r rod od right ot of way tor for about two miles across the lands ot of the bear river stilt lands company to the strip set aside as a public shooting grounds near the mouth ot of the bear river the order was not strenuously opposed by the manager ot of the company and was granted with the understanding that it did not mean that the publia necessity for or such a thoroughfare is admitted at this time the action was taken by the court in proceedings to condemn a right of way tor for the highway brought by the county commissioners sio ners the court wednesday therefore made it t possible tor for the public to reach the coming duck shooting season which opens october 1st ast next monday I 1 it t la Is possible that some questions which have arisen in the past may be settled through the filing ot of these ca cases i such as to whom does the land belong which involves the question 61 riparian rights meander lines navigability ot of waters and a lot ot of other important questions it Is stated that before some ot of these questions are fin ally settled the case may reach the supreme court of the united states persons intending to shoot at the public shooting grounds there this year commissioner madsen said wednesday should come to brigham city and there turn west to corinne and follow the main highway toi 0 DO point ol of intersection with a railroad spur into the heet beet fields turning south along this thia spur the te hunters will go to the chesapeake duck club grounds crossing a portion of these to the river at that point poin tIt it is expected that by noon sunday a ferryboat will have teen constructed 14 and 40 feet long capable of carrying three automobiles on one trip this thia will be operated by the fish and game protective association of box elder which will charge 1 per automobile regardless of the number of passengers carried in the machine hunters continued commissioner madsen should understand that this year they go ow on the north side aide ol of ther tee river to the terry ferry instead of on the south side ot of the river as last year last year the charge tor for crossing the reeder bridge to gain access to these grounds was 1 a passenger I 1 through the cooperation ot of the I 1 chamber ot of commerce at brigham city ail service stations garages motels hotels and grocery stores at brigham city will have information as to the proper route to take and at least two men will lie be stationed along the road to direct the traffic in addition the road will be signed with proper durec diorec tiona to the automobile driver no mo hunters are permitted to stop on them the north side ot of the river which is privately owned land the holdings of the bear river silt lands co on the south side of the river will ie be signed and the department wants the public to keep off the privately owned grounds and on the public shooting grounds which comprise bract practically cally 1 the entire entyre shore line hunters are also urged to close gates they may pass through and to be careful not to disturb nor destroy livestock by unnecessary discharge of guns there is every indication that shooting will be good frost front monday alunday until the bay is frozen over with the present storms the irrigation season will probably close and the greater volume of water in the river will raise the surface of the bay several inches flooding the marshes and making the shooting still better use of sink boxes and shooting pits will be permitted on the entire shore line from a point about half bait a mile north ot of the new state duck club in davis county and extending north perhaps thirty miles to the public shoot ing grounds warden james hull will be at the public shooting grounds to give directions as to the
