H Bo It enacted by tho Senato and Houso of Representatives of tho United States of America In Congress assembled, That every person, firm or corpora- IH tlon engaged In tho manufacture, preparation or compounding of food for IH human consumption, shall print In plain view ou each pnekngo thereof mado IH by or for thorn shipped from any Stato or Territory, or tho District of Colum- bla, a complete and accurate statement of nil tho Ingredients thereof, defined HI by words iu common uso to descrlbo said Ingrodlents, together with the H announcement that said statement is mado by tho authority of, nnd guaran- HJ teed to bo accurate by, tho makers of such food, and tho name and complete HJ address of the makers shall bo affixed thereto; all printed In plain type ot a U slzo not loss than that known as eight point, nnd In tho English language. S Sec. 2, That tho covering of each and every packngo of manufactured, proparcd or compounded foods shipped from any State, Territory or th District of Columbia, when the food In said packago shall have been takes. H trom a covering supplied by pr for tho makers and re covered by or for tUm HJ sellers, shall boar upon Its face or within Its enclosure an accilrato copy ot 'H the statement of Ingredients and name of the makers which appeared upoa HJ the package or covering of said food as supplied by or for tho makors thereof, HJ printed In like manner as tho statement of tho makers was prlnled, and such H statement shall also bear tho namo and address of tho person, firm or cor- H poratlon that ro-corered such food. IH Sec. 3, That It shall bo unlawful for nny person or persons to purposely, H wilfully and maliciously remove, niter, oblltorato or destroy such statement' III ot Ingredients appoarlng on packnges of food, ns provided In tho preceding III sections, and any person or persons who shall violate this section shall be jrm guilty of a misdemeanor, and upon conviction shall bo fined not less thaa' f 9 ono hundred dollars nor moro than fivo hundred dollars, or lraprlsonod fl less than ono month nor moro than six months, or both, In tho discretion ot! la tho court. im Sec. 4, Thnt tho Bureau ot Chemistry of tho Department of Agriculture v ! shall procure or causo to bo procured from retail dealers, and analyze, or IH cause to bo analyzed or examined, chemically, microscopically, or otherwise, ffl samples of all manufactured, propared or compounded foods offered for sale M In original, unbroken packnges In tho Dlstrlst of Columbia, In nny Territory, n or In any Stato other than that In which thoy shall havo beon rospectlvoly II manufactured or othorwlso produced, or from n foreign country, or lntcnde II for export to a foreign country. Tho pecretnry of Agrlculturo Bhall make fa necessary rules and regulations for carrying out tho provisions of this Act, M and Is hereby nuthorlzod to omploy such chemists, inspectors, clerks, labor- fl ers, nnd other employees, ns may bo necessary to carry out tho provisions H of this Act and to mako such publication of tho results of tho examination! U nnd analysis as ho may deem proper. And nny manufacturer, producer or dealer who shall rofuso to supply, upon nppllcntlon and tender and full pay raont of tho selling prlco samples of such articles of food to any person Jl duly nuthorlzed by tho Secretary ot Agrlculturo to recelvo tho same, shall I bo guilty of a misdemeanor, and upon conviction shnll bo lined not oxcoedlng il ono hundred dollars, or imprisoned not excocdlng ono hundred days, or bottt. 'I Sec. D, That any person, firm or corporation who shall vlolato soctlon il one and two of this Act shall bo guilty of a misdemeanor, and upon convic- 'I tlon shall be fined not exceeding two hundred dollars for tho first offonse il and for each subsequent offenso not oxccodlng threo hundrod dollars or be ti imprisoned not exceeding ono year, or both, in tho discretion of the court. See 0, That nny person, firm, or corporation, who shall wilfully, purposely LI or maliciously change or ndd to tho Ingredients of nny food, mako false Wi charges, or Incorrect nnnlysls, with tho purposo ot subjecting tho Tnakors ot U such foods to fino.or Imprisonment undor this Act, shall bo guilty of a mis- II demeanor and upon conviction shall bo fined not exceeding ono thousand II dollars nor loss than threo hundred dollars, or Imprisoned for not less than Ml thirty days nor moro than ono yoar, or both. yl Sec. 7, That it shall bo tho duty of every district attornoy to whom the 11 Secretary of Agrlculturo shnll roport any violation of this Act to causo pro- it ceedlngs to bo commenced and prosecuted without dolay for tho fines and sh I penalties In such caso provided.
