| Show ORDINANCE NO 33 an ordnance granting a franchise to tho the los loa angeles anti and salt lake railroad company BE BD IT ORDAINED BY THE BOARD OF COUNTY commissioners OF THE COUNTY OF GARFIELD STATE OF UTAH SECTION 1 that there la Is hereby granted unto tho the los angeles and salt lake railroad company a corporation pora po ration tiou its successors and assigns the franchise and right to please anil and maintain poles and wires with tho necessary or convenient cross croaa arms braces anti and other necess necessary iry fixtures over upon along and or n the lie publeo roads alloys highways and thoroughfares ot of the county of garfield suito state of oc utah and t till unincorporated corp orated towns in sald said county for the purpose ot of operating private telephones and felegi telegraph a p h I 1 lanoi in es in hi connection liec tion with tho the handling handl ng of its business in furnishing the ginneral public nt at zon national park washington county comity cedar city iron county anti and daryce danyon canyon garfield county ond end in cow ducting its passenger bus freight and express truck lines between said places and provided that posts shall be so placed and the wres upon them be kept at such elevation and so atta attached chea and secured as to avoid danger to persons persona and adjacent property and so as aa to present the least possible obstruction and lence fence to tho the traveling pubic SECTION 2 said los angeles and salt lake railroad company Is hereby granted the right to permit other companies or persons that have tho franchise right to io construct maintain and operate ororato public or private Ael telephone ephone and telegraph ines in this county to attach their telephone and telegraph wires together with other necessary fixtures upon its ita said poles SECTION 3 the period of this franchise shall be fifty years subject to the terms and conditions hereinbefore contained and the rights herein granted shall not be exclusive and the board of county commissioners reserves the power to g grant rant to others like privileges except that no franch franceso so shall be granted to any person or company to hereafter construct and or operate high tension power lines with wires carrying heavy currents of electricity in close cose proximity to the telephone and telegraph line of the los angeles and salt lake railroad company or crossing the same without providing and requiring in such power lines franchise that the same shall be constructed ted and or operated in accordance with the rules regulations and specifications when the pubic dutill commission of the state of utah has or may hereafter adopt for the construction and operation ot of commercial power lines SECTION 4 this ordinance shall take effect twenty days daya from the date of passage thereof the all members ol of the board voting in favor of said ordinance the vote being as follows for said ordinance james N hearle john H johnson against said ordinance pone none this franchise passed and granted this day of august AL A D 1926 1929 BOARD OP OF COUNTY commissioners GARFIELD COUNTY STATE OF UTAH by james N hearle chairman attest J T county clerk |
