Show NOTICE OF TRUSTEE1S SALE. Whereas, Charles August Allen and Elon L, Alien, his wife, of Utah Countv, Utah, executed, exe-cuted, acknowledged, and delivered to James H. Bacon, trusten, their certain trust deed, bearing date the first day of December. A. D. 1890, which said trust deed was recorded in the iecorder'8 office of Utah County, Utah, in Book "8" of Trust Deeds, on paires 228, 229, 230 and 231 of the records cf stid oitice, and given to secure se-cure tho pavment of Twenty-two Hundred Dollars, as evidenced by a certain first mortgage bond or note, bearing even date with said trust deed, and payable on the first day of December, A. D. 18y5, with interest thereon at the rate of eight per cent, per annum, an-num, payable semi-annually, as evidenced by ten interest counons to said first mortg. ge jondorno'e attached, and which said trust deed was given upon the following described premises, situated in the County of Utah and Territory of Utah,to-wit:;commencngtwenty-(20; chains north of the southwest corner of section sec-tion twenty-nine (29) township eight (8) . south of range two (2), east Salt Lake meridian; thence east twenty (20) chains; thence north ten (10) chains :thence west twenty 20 j chains; thence south ten 1101 chains to the place of beginning. be-ginning. Also, commencing thirty, 30, chains north of the southwest corner of Bection twenty-nine, 29, township eight, 8, south of range two, 2, eas. SaltLake meridian, run thence north fifteen, 15, chains, thence east ten, 10, chains ; thence south fifteen, 15, chains, thence west ten, 10' chains, to beginning. Area fifteen, 15 acres Also lot four, 4, in block one nundred and fifteen, 115, plat "A" Provo City survey, Area seventy-two, 72, square rods. Also one-fourth of the water in the Pond i'own Slough, together with any and all water rights owned by the said Charles August Allen and Elon L. Allen, or either of them, or belonging to or with or used upon said premises, or any part thereof. And Whereas, it is provided in said trust deed among other things that in case default be made in the payment of either of said notes, indebtedness, or moneys secured bv said trust deed, or of the taxes or assesssments on said premises or any part thereof, or in case of the breach of any i.f the covenants in said trust deod contained to be kept and pert' ormd bv the said Charles August Allen and Elon L. Allen, then to sell and dispose of said premises, prem-ises, or any part thereof, and said water rights, together with all the right, title, benefit bene-fit and equity of redemption of the said Charles Ausust Allen and Elon L. .alien, thuir heirs and assigns iherein forever, either in mass or in separate parcels, as the holder or holders of said bond and notes may prefer, at public auction, at the front door of tje Court House in the County of Utah and Territory of Utah, or on said premises, as may be specified in the notice of such sale for the highest and best price the same will bring in cash, after first giving tnirty days previous notice ot such sale by publication in any newspaper at that time published in the said County of Utah.and to mane, execute, acknowledge and deliver to the purchaser or purchasers at said sale good and sufficient deed or deeds of conveyance for the premises sold. (And Wherpas, ittsaiso provided In said trust deed, among other things, that in case default be made in the payment of any or either of the indebtedness or moneys secured thereby-whether thereby-whether of principal or interest, or f the breach of any of the covenants in said trust deed contained, to be kept and performed bv the said Charles August Allen and E'onL. Allen, then any and all of the moneys there. by secured shall upon such default, at the option of the holder of said indebtedness, become be-come immediately due and payable, anything in said trust deed or in said bond or notes contained to, the contrary, notwithstanding. And Whereas, Charles August Allen and Elon L. Allen have both and each made default in the payment of the interest on said indebtedness, due on the first day of December, A D. i893: on the first day of June, A. D, I89t; and on the first day or December, A. D. 1894; nd Whereas, trie legal holder of said indebtedness indebted-ness has declared the whole ol said indebtedness indebted-ness to be now immediately due and payable and requested said trustee to advertise and sell said premises and water rights, pursuant to tho power and authority in him vested in and by Baid trust deed ; and Whereas, it is also providad in said trust deed that in case of the death, absence from said Utah County, inability or refusal to act ot the said James H. Uacon. that then Harvey M, bacon shall be and is by said trust deed appointed and made successor in trust to said James H. Bcon,with like powers end author- ' lty, and said premises thereupr a becomes vested in said successor in trust, for the uses land purposes in said trust deed mentioned; and Whereas, said James H. Bacon is absent from said Utah County, unable to and refuses to act in the premises, Now therefore public notice is hereby given that I, Harvey M. Bacon, s iccessor in trust as aforesaid, will on Thursday, the 21st day of February, A. D. 1895. at ten o'cloc a m. of said day at tue north frontdoor of the County Coun-ty Court House in the City of Provo. in Utah County, Utah, sell at public auction to the highest and best bidder for cash, said premises prem-ises and water rights hereinbefore described, together with all the right, title, benefit and equity of redemption of the said Charier August Allen and Elon L. Allen, their heirs and assigns therein forever for the purpose of paying said indebtedness and interest thereon, there-on, and thecosts, attorney's feesand expenses of executing this trust, and will make, execute, exe-cute, acknowledge and deliver to the purchaser pur-chaser cor purchasers at said sale, good and sufficient deed or deeds of conveyance for the premises sold.
