| Show SAR PIT BEA L COMES TO HEAD A special meeting of the city council was held friday evening for the purpose of considering a number of matters present were mayor peters arid and councilmen phillips dunn hansen and lawson the matter of completing the swimming pool at rees park and making other improvements there was waa considered and action defer deferred for the present the matter of the purchase of the sand pit by brigham city from arthur J munns and wife ast june aas was discussed and it was derided decided to demand a refund ot of the money paid to mr 11 II C carver amounting to 2175 accordingly a resolution was una alinus ly passed as follows whereas on or about the aud and day of june A D 1917 brigham city corporation paid to IT II C carver the sun alm of 2473 2475 to be the purchase price of the following described real estate situated in dox box elder county state of utah to wit then follows a Je retailed tailed lai ailed description of the ground in question quei tion which said was nt at that time owned by the said I 1 H T C carver by virtue of a deed from arthur J munns and mary alary A munns his wife to said 11 C carver and whereas upon the payment eiA of the said money it was he dary dur of the said carver to execute and deliver to brigham city corporation a good and sufficient deed to said and whereas the sald said carver has never made any conveyance of said property to brigham city corporation and the said corporation has nu no tiie to the same whatsoever 1 now therefore be it ie solved that brigham city corporation does hereby rescind its action in paying said sum fum of 2475 to the lie said IT II 0 carver tor for said yand does hereby author ize and direct the city recorder ot of brigham city corporation to make an mediate immediate demand upon the said ff C carver for the return to biggham city corporation the said sum of 2475 with wit t interest from the time ol of payment t f the same to wit from the 2nd and day ot of june A D 1917 and that a copy of this resolution be delivered to the said I 1 H C carver in accordance with the of the above resolution city recorder noble AL Fis fishburn liburn delivered a copy of the resolution accompanied by a v itten demand tor for the return ot of the money mo to mr carver friday evening |
