The people of the Territory of Utah send greeting: To David P. Felt. Addie Felt, Felt Olson & Co., composed of David P. Feit, M. L. Silver and Edmund Olson, partners, Stephen B. Moore, Provo Lumber Manutacturing company, com-pany, a corporation, t'rederick H. Auerbach, Samuel H. Auerbach, Andrew Knudsen and Herman Knudsen, partners, Provo Commercial Com-mercial & Savings bank, a corporation. Davis Brothers. Bertman & Co., Bernard Brothers & Spindler, a corporation, defendants. You are nereby required to appear in an action ac-tion brought against you by the above named plaintiff, in the itstrict court of the First Judicial Ju-dicial districl'omiib territory of Utah, and to answer the complaint filed therein, within ten days (exclusive ot the day of service) after the service on vou of this summons if served within this county; or if served out of this county, but in this district, within twenty days; otherwise within forty days or judgment judg-ment by default will be taken against you, according ac-cording to prayer of this complaint. Tho said action is brought to obtain a decree of this court for the foreclosure of a certain mortgage described in the complaint, and executed ex-ecuted by the said David P. Felt and Addie Felt on April 14tt , Is90, and given to secure pavment of a certain promissory note for the sum of t5,000 with interest at ten per cent, per annum from date until paid, signed by said David P. Felt and Addie Felt, and addi ionally secured by a certain promissory note signed by Felt Olson & Co., fully set out and described des-cribed in the complaint; that the premises conveyed thereby may be sold and the proceeds applied to the payment of the costs and expenses of this action including an 1 attorney fee of $."ti0.00 as provided for in said mortgage and the amount found due as principal prin-cipal with interest thereon at 10 per cent, per annum from May 2, 1891; that the defendants and all persons claiming, by.through or under them be foreclosed of ,all right, title interest and equity of redemption of, in or to the said premises or any portion thereof, and that the lien of plaintUI be declared to be the first on the premises described in said mortgage.
