Show NOTICE OF TRUSTEE'S SALE. "Whereas, Charles August Al'en and Elon L, Alien, his wife, of Utah Countv, Utah, executed, exe-cuted, acknowledged, and delivered to James H. And Whereas, it is provided In said trust deed among other things that in case default be made in ' he payment of either of 6aid notes, indebtedness, or moneys secured by said trust deed, or of the tayes or assesssments on said premises or any part thereof, or in case of the breach of any of the covenants in said trust deed contained to be kept and performe-d by the said Charles August Allen and Elon L, Allen, then to sell and dispose of said premises, prem-ises, or any part thereof, and said water rights, together with all the right, title, benefit bene-fit and equity of redemption of the said Charles August Allen and Elon L. Allen, their heira and assigns therein forever, either in mass or m separate parcels, as the holder or holders of said bond and notes may prefer, at public auction, at the front door of tae Court House in the County of Jtah and Territory of Utah, or on said premises, as may be specified in the notice of such sale for tbe highest and best price the same wi'l bring in cash, after first giving tnirty days previous notice ot such sale by publication in any newspaper at that time published in the said County of Utah.anu to make, execute, acknowledge and deliver to the purchaser or purchasers at said sale good and sufficient deed or deeds of conveyance for the premises sold. lAnd Whereas, it is aiso provided in said trust deed, among other things, that in case default be made in the payment of any or either of the indebtedness or moneys secured thereby whether of principal or interest, or t f the breach of any oi the covenants in said trust deed contained, to be kept and performed bv the said Charles August Allen and Elon L. D. 1894; nd Wherfcas, the legal holder of said indebtedness indebted-ness ha?declared the whole ol said indebtedness indebted-ness to be now immediately due and payable and requt-sted said trustee to advertise and ft-Tl Bnit.remise8 and water rights, pursuant to tbeTCJver and authority in him vested in and by sajtd trust deed ; and Whereas, it is also providsd in said trust deed thnt in case ot the death, absence from said Utlh County, inability or refusal to act ot the Raid James H. Bacon, that then Harvey M. LSaioii shall be and is by sid trust deed appointed and made successor in trust to said Jamefi n. Bicon,with like powei's end authority, author-ity, (tind said premises thereuprn becomes vestrd in said successor in trust, for the uses and purposes in said trust deed mentioned; and Mhereas, ead James H, Bacon is absent from said Utah County, unable to and refuses to act in the premises. Now t herefore public notice is hereby given that I, Harvey M. Bacon, successor in trust as aforesaid, will on Thursday, the 21st day of February, A. D. 1895, at ten o'cloci a m. of said day at the north frontdoor of the County Coun-ty Court House in the City of Provo. in Utah County, Utah, sell at public auction to the highest and best bidder for cash, said premises prem-ises and water rights hereinbefore described, together with all the right, title, benefit and eauity of redemption of the said Charlef August Allen and blon L. Allen, their heirs and assigns therein forover for the purpose oi paying said indebtedness and interest thereon, there-on, and the costs, attorney's fees and expenses of executing this trust, and will make, execute, exe-cute, acknowledge and deliver to the purchaser pur-chaser tor purchasers at said sale, good and sufficient deed or deeds of conveyance lor the premises sold.
