The Utah commission has adjourned until January 2, 1895, at 10 o'clock in the forenoon. Smith, ihe great defeated, de-feated, dropped in, accompanied by a sweet, sad smile and engaged in a discussion dis-cussion with Commissioner Thatcher on the future possibilities of electricity and the best means .of reducing flesh. Having finished his anti-fat dissertation, disserta-tion, Mr. Smith turned his attention to matters political and, addressing his audience in an informal way, remarked that in affaire of this kind he disiineci to'see anything of a nature which might be construed as approaching gerrymandering gerry-mandering or traudulent proceeding. All of which. was delivered in so serious a tone that a casual listner would have readilv believed the speaker in earnest. Mr. Smith bad just concluded an assertion as-sertion to the effect that his heartfelt belief was that every action in life has its compensation, when Mr. Letcher's bright and Bunny face passed the lintel. Mr. Smith bestowed be-stowed another of his bland smile3 upon the board and softly wended nis ruminating rum-inating way down town. The board then went into the matter of finishing finish-ing the canva3S of the county of San Juan. Owing to the absence of the books and taily sheets from La Salle precinct pre-cinct and the lists fiom Indian Creek and McElmo, San Juan county, the canvass was passed. The returns in dicate the election of F. A. Hammond (dem.), as far as the count has progressed. pro-gressed. The cany ass of the returns irom Uintah county was then resumed. Johrson, democrat, is elected. At 11 o'clock Judge Miner, attorney for llobert Mcrarland and James N. Kimball, republican candidates for the constitutional convention from "Weber, came in and served notice on the commission com-mission that it must not open the ballot bal-lot boxes from any precinct in Weber county, or a writ of prohibition would be applied for. The notice was in the usual form. Commissioner Sherman moved that the requests be granted. The motion waB lost. Ayes Tatlock, Sherman 2. Noes Norrel, Thatcher, Letcher 3. Commissioner Norrel moved the exclusion ex-clusion of all persons from the room with the exception of candidates or their representatives, in pursuance with the provisions of the statute. This motion met with no second. Judge Tatlock then offered the following: fol-lowing: ..That if anv ballot boxes from anv part of Weber county are to be opened and a recount of the ballots in paid boxes is to be taken that said recount be taken with open doors." This was seconded by Mr, Sherman. Judge Norrel offered as a -substitute that in canvassing the ballots can-tained can-tained in any ballot box by this com mission only such persons Bhall be permitted per-mitted in the chamber during the count as designated by law. Aves Norrell, Thatcher, Letcher 3. Noes Tatlock, Sherman 2. The reporters were invited to withdraw. with-draw. They did. The board then proceeded to open the box from Uintah precinct, Weber county, Messrs. Tatlock and Sherman refusing to participate in the re count. They, however, kept a tally of the votes, which agreed with the judge's returns. After completing the count of this box the board took a recess until 2 o'clock. At that hour Deputy . Marshal Cannon Can-non appeared with two writs of prohibition prohibi-tion in behalf of Eoberi McFarland and James Kimball, of Weber, returnable December 31th. ' The commission obeyed the mandate . of the court, quit canvassing and adjourned ad-journed until.January2, 1895, at 10 ! o'clock. . " NOTES. As regards the election of constitutional constitu-tional delegates, no certificates of election elec-tion will be issued until after the court has passed upon the pending writs of mandate and prohibition. The com mission has as yet declared no official returns. Clerk W. H. Lett and Dewey Eich-ards Eich-ards yesterday completed ;the work of mailing certificates of election in duplicate dupli-cate to the successful candidates throughout the territory. The ballot box from Slateryille precinct, pre-cinct, Weber county, was yesterday re-I re-I ceived at the commission office. Clerk Blair is busy, and will continue so for a day or so more, in forwarding checks to the various registrars and deputy dep-uty registrars in the various counties. They will come in veiy handily as Christmas expenses. On request of Deputy Marshal Exum of Ogden, the boxes from poll 2 of the Third Ogden precinct and poll 1 and 2, of the Second Ogden precinct were ys-terday ys-terday forwarded to the Junction city for use in the graid jury investigation now pending there. |
