Show OFF FOR NEPHL All the Officers of the First District Court TO OPEN THE MAY TERM. A Short Term of the February Term Held Here This Morning- The Triangle Iron Fence Near the .XT P. Depot Declared a Nuliance Other Business. Judge King before goiog to Nephi this morning to open the May term of the First District court held a short session l.ere. Decision in the suit of Proyo City et al vs. the It. (i. V. liy. cumpany. tried some monthB ago and taken under ad-yisement ad-yisement was rendered. This suit was brought over the iriacgular fence enclosing en-closing a grass plot near and hindering access to the Union Paciuc depot, this city. The Rio Grande Western by purchase from Alex Sutherland who purchased the ground from Peter Stubba the original owner in 1881, pro-carred pro-carred the record title to the ground. Although Borne taxes were paid by Mr. Sutherland during the time he owned it, yet 'or upwards of ten years it was used as a public highway. The suit was brought by the city, the Union Pacific By. company paying all ex penses, to recover possession of the ground for continued use as a public highway. The decision was in favor of the plaintiff, declaring the enclosure to be a hindrance upon a public highway high-way of the city. Toe case will be appealed. ap-pealed. In the suit of J. W .. Whitecotton vs. D. S. Dana an order was made setting set-ting aside sale of certain real estate in Payson, the property of D S. Dana, uuder an execution against Dana and in favor of Whitecotton for the reason that the reel estate consisted of several sev-eral parcels and was not sold in parcels un il the judgment was satisfied but was sold in bulk. The motion for a change of venue In the suit of J. Smith vs. the ft. G. W. Railway company to the Salt Lake court was denied. The repor'er was ordered to transcribe tran-scribe the testimony of witness Anderson Ander-son in the suit of George L. Hyde vs. Joseph L. Nelson et al, for the reason that there is some dispute and misunderstanding mis-understanding as to exactly what he testified concerning the number of sheep he had in his herd, what number of these were placed in by Hyde, etc. The February term of the Fir&t District Dis-trict court was then adjourned to June 1st and the iudge and other officers of the court hied themselveB to the U. P. depot where they boarded the train for Nephi. |
