Show DISTRICT GOURTe The Big Mining Suit Settled Temporarilly AFTER THREE LONG DAYS The Order Hade Hearing of the Cause Set tor October I9th Another Order Made in the Pemberton vs Fiddler Case Some Cases Filed Since Monday morning Judge Smiths time has been occupied hearing testimony and tee arguments of many able attorneys in an important mining suit The title of the case is the American Eagle Mining company a corporation and Otto Mears vs V F Clays A R Haicom James T Wall and John Sullivan Both plaintiffs and defendants asked the court for an injunction restraing the other from working certain mining property In the Tintic mining district The defendants defend-ants asked the court to give them 8200000 damages for ores already extracted ex-tracted from the disputed property The case was hotly contested by Brown fi Henderson and Dye Street for the plantiffs and Hoffman and Snyder W H Dixon Bennett Marshall Bradley of Salt Lake and Tlmrman Wedgwood of Provo for the defendants Judge Smith on Saturday last visited the disputed property and he has for three days listened attentively to the statements of numerous experts and the arguments of the attorneys At 4 p m last Thursday evening he unannounced announced his decision enjoining tue defendants as prayed in the complaint and enjoining the plaintiffs in part only as prayed in the crosscomplaint and directing that a written order be prepared signed and filed fully defining the extent of such injunctions The bond on behalf of plaintiffs against defendants was fixed at 8500000 and on behalf of defendants de-fendants and against plaintiffs at 3 00000 By agreement of counsel the the hearing of the cause was set for October 19 1894 The time of the court this morning was occupied in hearing evidence in the case ot Martha J Pemberton et al vs Teletha Fiddler et al one of the cases arising out of the much litigated Drake estate H C Edwards was allowed al-lowed to file a petition in intervention Mr Edwards is suing Teletha Fiddler for attorneys fees Andrew John Andersen formerly of Sweeden declared his intention of becoming be-coming a citizen of the United States and court adjourned till 8 oclockSatur day morning Cases have been filed as follows Sophie Snyder vs H E Osterloh and wife for foreclosure on mortgages securing secur-ing promissory notes 650 due December Decem-ber 20 1890 550 due December 15 1891 8900 due January 11 1893 and 5100000 due July 3 1893 David N Swan et al vs Hudson Smith et al Complaint alleges that the Brokljn mining claim overlaps the Shamrock mining claim Property in Tintic mining district Charles VV Bennett et al vs same defendants Complaint alleges that the Brooklyn mining claim overlaps the American Flag mining claim Property in Tintic mining district |
